Vermont Bans Mags & Bump Stocks, Criminalizes Private Transfers, Raises Purchase Age

Vermont’s historically free gun laws are about to get a good-ol’-fashioned anti-gun makeover. In the wake of the Parkland massacre, Vermont’s General Assembly has proposed a variety of measures aimed at curtailing the ownership of “large capacity” magazines, raising the legal age to purchase a firearm, requiring background checks for private gun sales, banning bump stocks, and allowing law enforcement to more easily confiscate firearms.

Vermont Governor Phil Scott has vowed to sign all three pieces of legislation if passed by the Assembly.

“As Governor, I have a moral and legal obligation and responsibility to provide for the safety of our citizens,” he said in a statement. “If we are at a point when our kids are afraid to go to school and parents are afraid to put their kids on a bus, who are we?”

The House and the Senate have already passed S.55, which will do the following:

  1. Raise the legal age to purchase a firearm to 21 for most residents;
  2. Ban the possession of magazines with capacities greater than 10 rounds for long guns and 15 for handguns (does not apply to magazines possessed before the legislation passed);
  3. Require a background check before transferring a firearm to a non-immediate family member;
  4. Ban bump stocks.

Vermont gun owners didn’t go down quietly. Gun rights activists organized a rally at the state capitol, where they handed out 1,200 free 30-round PMAGs.

“I’m here to support our 2nd Amendment rights,” Vermont resident Mike Gallo told the Burlington Free Press. “If we don’t protect them, we won’t have them when we need them.”

Sen. Joe Benning, who voted against S.55, told the several thousand protesters gathered on the Capitol steps that both sides of the gun control debate want safer communities and schools.

Still, “you guys are as passionate as the other side was,” Benning said. “I know you are going to find this difficult to believe, but some of those folks on the other side are really scared of you.”

The remaining two bills—H.422 and S.221—have yet to clear both chambers, but the governor has promised to sign these as well.

H.422 would require law enforcement officers to confiscate a firearm from a person who is arrested or cited for domestic assault if the weapon is (1) in the immediate possession or control of the person being arrested or cited; (2) in plain view of the officer; or (3) discovered during a consensual search.

S.221 is likewise dedicated to giving law enforcement a clearer path to gun confiscation. This bill, like many proposed in states across the country, establishes “extreme risk protection orders,” which allow law enforcement to seize guns from individuals they believe pose a danger to themselves or others. The law requires police to provide “clear and convincing evidence” to the Family Division of the Superior Court.

Vermont isn’t alone in its push for stricter gun restrictions. State legislatures from coast to coast are considering similar proposals.     With his stated position on guns and magazines Vermont’s Governor Phil Scott is proving that he is another political hack who a) has no concept of cause and effect b) has more interest in hearing his own sound bites or c) is just completely bamboozled by the aura of the liberal machine that suggests that you you do not need to accomplish anything as long as you are caught on tape saying the right things. I spent over two years working in Vermont and the conclusion I came to is that there are basically two types of people residing there. I ran into a lot of the old time Vermonters who are self reliant and had a belief that they did not appreciate others telling them how to live so they were not prone to try to tell others how to live. Then there were to folks who moved there or bought second homes there to “get away from the big city life” and now want to turn the town they have contaminated into the same cesspool they came from. Those folks have no problem telling others how backwards they are and how they need to change. The second group is becoming larger and dominant as they take over the “Assembly” and try to turn the idyllic towns and cities of VERMONT into an extension of Hartford, CT and NY, NY. I hope the truly good people of Vermont realize that if they do not take a stand to preserve what is left of their lifestyle, they will find themselves exiles in their own land. God bless you on whatever path you end up on. Your two choices are to choose your own destiny, or allow the flatlanders to choose your destiny for you.

      I’ve seen much critical commentary on this website concerning the bump stock ban, and everything else that has only been mentioned, let alone legislated.

    It is beyond me to understand why there are so many individuals with, I assume, reasonably average intelligence, who are so naive and/or ignorant, that they cannot understand that gun and gun gear prohibition laws will do absolutely nothing to help curb the magnitude of violence occuring in our country today. Those who feel a need to kill, will do it, one way or another.

    Prohibition laws against the tools that law-abiding citizens need and deserve for protection from violence, only serve to make it more dangerous for the victim and safer for the assailant. Only the law-abiding obey laws.

    Are we expected to believe that these prohibition laws would apply to the bodyguards of the lawmakers?

    Let me see if I have this right; First the FBI gets the information on this kid about his wacked out plans, then sets on the information and does nothing. Then the local Coward County cops get the same word on this kid, they set on it and do nothing. Then said kid posts on social media exactly what he is going to do and that is ignored. Kid follows through on his quoted plans and shoots up a school. The on site local cop says over the open line for everybody to stay back there is somebody shooting up the school and then goes an hides in the corner while doing nothing. Kid get done takes off and gets nabbed unarmed and gets tossed in jail. Then everybody goes nuts and blames everybody and ALL THE BLACK GUNS and legal gun order get the bad rap for this kids actions. Now bans on legally owned weapons are getting passed all over the country, anti gunners dream come true. So once again the law abiding gun owners are getting the blame and the kid gets three hot meals, free housing, no bills. The Framers of our country are spinning in their graves over this BS.     OK here we are complaining about the complainers which is just the same old same old. Me, Gunner for 54 years, NRA brought me in at age 12, and I am still going strong. The NRA sure ain\’t what it use to be. My take is simple, I have lived with gun regulations like They are trying to pass again, and they did not hurt me. I look at this this way, Gun don\’t kill people, yet people with guns kill people……. My challenge, meet me in the hallway at school, bring your Fav Daily CC (I have had one for about 40 years, so u should have one), I will bring one of my AKs or maybe my SKS BullPup, either way I will have a 30 rd mag. Guess what no one will meet me, but maybe if we did limit the mag to 10 rounds they would show up. Yet we want our Teachers to use a small CC pistol against me and my 30 round mag. Now if you are able to see but still cannot see this, I feel Sorry For You. But, please get out of the way as we can protect our kids and ourselves, and at the same time protect The 2nd!

      I don’t have bump stocks, or a long deep love affair with black rifles, hi cap mags or plastic pistols, BUT- I do defend other law abiding citizens right to own them if THEY see fit. Just as I support THEIR choice to have an automobile or motorcycle which exceeds 55 MPH; or an asinine “smart phone”, both of which cause far more innocent deaths every year than ANY type of firearm or accessory. I guess the difference between you and I don’t believe it’s just about “ME”.

      To go along with an erosion of personal rights so a group of individuals and some self serving politicians can feel better or virtue signal is just plain wrong and our forefathers are probably spinning in their graves at what WE have let happen to their legacy through apathy, selfishness and stupidity.

    The police used to have a law that allowed them to force someone into a mandatory 3 day mental health evaluation. They abused it though, and Ronald Reagan took it away. It is plain to see that they will only end up abusing this law too. To solve it, every police force should have an on-call panel of the psychiatrists to make the evaluation if someone is an extreme risk. Cops and courts have no training to evaluate someone’s mental health.

    One would have never thought that this could happen in a state like Vermont. But like many states across the country, the large urban cities control the government, and the government is made up of liberals. This latest attack on the 2nd Amendment in Vermont should be a wake up call to the millions of gun owners, from ALL Parties. The war to protect and preserve legal gun ownership is being lost one battle at a time. While the groups that make up the anti-gun movement are focused, well funded, passionate, and stand solidly together, gun owners are mostly the opposite. I can’t imagine gun owners in America putting together a March for Our Rights, on the scale and coordination of the March for Our Lives, that the anti-gun movement put together recently. There seems to be a lack of leadership within the pro gun movement. Another fact is unless we take back control of our education system, the youth of America will continue to be indoctrinated and used as pawns by the left to achieve their anti-constitutional goals. Gun owners have been silent too long, and now have come to a fork in the road. If we allow the left to continue to win the battles, there is a probability that we will lose the right to keep and bear arms at any moment.

      The freedom loving people of the United States are on their own. We became complacent, soft, happy with our daily lives and buried all of the evidence of what was coming without once considering our future generations

      This isn’t a statement on all freedom loving, Pro 2nd Amendment supporting gun owners but many. Now everyone is in a sabre rattling, decision making mode.

      Many “Supporters of the Constitution and Bill of Rights will succumb and do what the government demands, thinking this will be better for their kids, grandkids etc. but in truth many are thinking about their cozy home, weekends at the lake or casino and will make any decision necessary to keep comfortable.

      Many people have never known struggle, discomfort, isolation or doing what they have to do and not what they want to do and many people are afraid of it.

      As for people that live in the cities I say good luck, too the people in the rural areas, I say good luck and give’em hell

    If anyone feels safer because of these superficial “Do something” laws, they are delusional? Evil will find a way. The only way to feel safe is to have armed guardians in place and then no guarantee that you will be safe because evil will find a way. That is the way it has always been, that is how it will always be. No laws will legislate evil criminals. We all know this. So leave the Bill of Rights alone and focus the resources and energy on mental illness.

    Btw, the governor’s name is Phil Scott, not “Bill”, and despite the fact that he’s a Republican, he’s been caving under the pressure of the current ant-gun fad. So the bottom line here is, don’t just vote for candidates based on their party affiliations. You need to check their records, see how they’ve voted in the past, then make sure to hold them accountable. Sitting by and thinking our elected officials have our rights under control is a BIG mistake!

    So why not pass more ineffective laws that won’t be enforced? Because you snowflakes will feel better. And we all know its all about your feelings right?

    Well, how about this for your feelings. If the laws already in place had been observed and enforced, the shooting would never have happened. Maybe you snowflakes should consider your own safety instead of believing more laws is going to provide it.

    It’s time for the Trump Administration to abolish the Promise Program implemented by the previous administration. The Promise Program was implemented to keep students from having anything on their records (school as well as criminal) as well as giving the schools Federal Funds for having low numbers of such incidents. The School Superintendent’s, Attorney’s, Law Enforcement (County as well as Local) are always involved, this is why the Parkland shooter Nikolas de Jesus Cruz did not have a police or school record. How many millions of dollars are these Liberal Indoctrinating Schools receiving from this Promise Program in order to turn a blind eye to cover up real incidences that should be reported and investigated. Get tough with our government not with our citizens rights!!!!! What part of “shall not be infringed” do these mental midgets not understand !!!! By the way the liberals don’t need to fear law abiding gun owners they need to fear those that seek to disarm our citizens as well as our country. HISTORY DOES REPEAT ITSELF !!!!

    Crazy… So NOW parents are worried about little itty bitty kids. Strange how just a few short years ago, parents were allowed to discipline these children so they knew between Right and Wrong. So because little kids are trying to outdo one another by the tally of their classmates,the rest of the Law Abiding adults are being penalized because of the brats they no longer can control. Little bastards should be disciplined a little better from the loser snowflake parents.
    If there is discipline within the “family” unit,maybe there wouldn’t be so many of the snowflakes “oh, my kids wouldn’t do that, my kids are wonderful” shooting up schools and their classmates because they were BULLIED by the same students they target. Go figure. There is over 300 million Citizens with Defense Weapons compared to the 3 or 4 million police officers and military…. It will be a quick Civil War. The United States will be once again, A Great Nation.
    There was a time when parents had guns in the home that weren’t locked up because these children of years past knew the difference between Right and Wrong. There should be a State these snowflakes can move to that is “gun free” so the police can enforce their own set of rules, kinda like one big concentration camp.

      New Hampshire is the “Live Free or Die” State…at least for now.

      The Republicans in our State Legislature have squashed attempts at panic postured anti-gun legislation for this session. Unfortunately we are currently being invaded by transplants who have ruined their native States (MA, CT, NY and NJ) with liberal tax and spend policies. They move here due to our fiscally responsible policies which have stimulated growth and kept our taxes low.

      Our imminent destruction has already begun as flatland buffoons overtake the voting rolls and destroy our State by continuing to vote for the same folish liberal ideas. This is readily apparent as seen in the slim majority vote for Hillary Clinton in the 2016 election; which also elected another transplant as a second Democratic US Senator.

      The definition of insanity, is, doing the exact same thing over and over again and expecting different results. It will only be a matter of time until the “Live Free or Die” motto on our license plates becomes another joke like “The Constitution State” did on Connecticut plates.

    Iam all for the age of 21being institued to purchase a firearm. Also raising the drinking age, right to vote to 21yrs of age.There is a nother issue of abortion over 50 million since 1973. This is a murder in it self and the burden should be shared with the parents or guardian

If you are unfortunate enough to live in any of these states, it might just be time to think about either voting or moving, in other words, put your money where your mouth is and support pro 2A candidates with actual dollars and not lip service.

    As for the provision to confiscate someones guns because of a domestic citation, any one know what that could mean in Vermont? How much does it take to be cited?
