Why Background Checks Are A Lie: Stopping Psychos and Gun Checks Are Unrelated

Anti-gun-rights crusaders keep calling for new and improved background checks. You know why. They dance in the blood of victims, using tragedy to manipulate for their goals. It’s what they do. Bottom line, they don’t want checks, they want all the guns.

The problem with the check scheme is that background checks are a lie. The crusaders’ big claim, constantly repeated on the old-news channels, is that the existing check has stopped about three million gun sales. What a glorious achievement. We need more of this, they say.

Not a single reporter in the entire profession has the brains, training or ethics to ask even the most obvious questions. This perpetuates the lie. Whether that’s deliberate, ignorance, stupidity, a plot, it doesn’t matter. What matters is it’s harmful. So I’ll ask.

Where are the three million arrests? Right?

It’s a serious crime to try to get guns if you legally can’t, you know that.

The check is designed to find criminals trying to buy guns at retail. The criminals banned are really bad dudes—bank robbers, rapists, murderers, fugitives, addicts, the mentally unstable, spousal abusers, jihadis, illegal aliens, there’s a federal list. It’s a long-term felony for these people to try.

What good is the background check if it finds these villains, has them right there in the store with the FBI on the phone for Pete’s sake, and we just turn them away? Do you know how much money we’re spending on this? Do we want to catch and lock up “the element” or not? We have their signatures on a form for proof. The background check is a lie.

But wait… are these people really guilty of anything? That’s one of the excuses the Brady supporters and authorities give (they have many) for not locking up virtually any of the desperados they identify: a positive hit in the system is insufficient grounds for dispatching an arresting unit. It’s not exactly court-quality evidence to press charges. Say what?

Put another way, those three million background-check “victims” experienced denial of their fundamental constitutional right to buy firearms by government clerks and a list. They could not confront their accuser, did not get a reason for the denial, and in significant numbers the denials were wrong. They were essentially convicted and denied their rights without a trial. Their due process was revoked. The background check is worse than a lie, it’s a travesty. For those three million denials, prosecutions are extremely rare, in low two digits annually, convictions are apparently not even routinely tracked.

Left-wingers dreamed this up, and got it enacted dancing in blood (they still do) back in the 1990s. It seemed to make sense, like many of their schemes, but in practice it is totally bogus. It destroys due process, plays find and release with criminals, can’t distinguish between the guilty and the innocent and wastes scarce funds. They don’t care, they just promote it like crazy, maybe because they are — and it is. Reporters march along. Shame on my journalism profession for the harm they cause. “If the media reported accurately on guns the debate would end.”

The BIDS system, the Blind ID System, performs a similar function, but it costs far less and doesn’t register gun owners by the tens of millions, like the current “NICS” system seems to. Gun-owner registration is the primary but unspoken goal of the current plan, another lie. When Janet Reno first built the thing in Clarksburg, W.Va., back in 1998, not only was it a registration system, in direct violation of the enabling statute’s ban on recording (18 USC §922 s&t), she had the audacity to announce that her $250 million computer could not erase records. There is no end to the hubris of bureaucrats and anti-gun-rights crusaders.

The FBI assures us none of the inbound gun-buyer data is stored in any way, but you can’t audit, and how much faith do you have in that? When I diagrammed the entire system for Gun Owners of America, (https://www.gunlaws.com/images/nicsbig.gif) it turned out NICS queries criminal databases in many lands (Scotland Yard, Mossad and Interpol, for example). There’s no indication those search records are wiped.

In the BIDS system, instead of gathering millions of innocent people’s names, licensed dealers receive the names of the bad guys, like wanted posters, and they check it out in their stores. Simple, efficient, encoded, logged so you can’t check out your daughter’s boyfriend. We trust certified dealers to sell guns, we can trust them to look up their customers in a secure phone book.

BIDS might make sense. The send-me-your-name NICS registration scheme is hoax-like from the word go. But ever since the presidency changed, the nation has learned how much one side perpetually lies.

POSTSCRIPT: When it comes down to it, the gun-ban cheerleaders won’t be happy until guns, “go away.” But there is no “go away.” They are guaranteed to remain dissatisfied, while we refuse to cooperate. Have the government take guns? You’re only giving them to Mr. Trump, who gun grabbers think is a Nazi personified, so that’s hopelessly irrational. Irrational. And even a wave-a-magic-wand disappearance method (or 100% effective bill) is nonsense, communist China would start imports worse than cocaine trafficking. South America too. All we face from the left on guns is mythology and Utopianism that interferes with life.

Right wing nutjobs have tried to make background checks as ineffective as possible. The fact is that background checks do work, albeit not as much as they should, and they are not gun control or an assault on 2a rights. It is nonsensical that any law abiding citizen would be against keeping criminals from purchasing guns.

How are FFL records destroyed after the process has either approved or denied someone to buy a gun? The law says it can’t be kept by the govt. What it doesn’t say is that there is probably a government contractor responsible for document distruction, and they covertly scan the documents before they are shredded.
That way, the govt., could ask the contractor, have you seen anything on john doe?, and still comply with the current laws.

Secondly, a Grey Associates fax analyzer lets you capture and re-create a fax with a pair of alligator clips to their board in a PC. So, install one of these on each FFL fax line and you get a bit for bit copy of every fax that arrives for an FFL check… People think faxes are secure but there is absolutely no security in the fax protocol. Yet, FAX is OK to use with PII and the medical community uses it all the time.

F B I looks like they make a lie look like the truth

Won’t hurt might help I say if we can prevent a felon or mentally sick Nazi or racial supremacist type persons with records from just walking in and carrying out a gun from anywhere is a good start and other than some conspiracy theorists thinking that is infringement could prevent innocent people from being murdered.

Except there is little to NO proof anything you posted has or will happen. And as pointed out, if NO prosecution of perp is established, what is the point?
He, she or it will simply find a lover, friend or confidant to buy one for them, a so called ‘straw purchase’.
Your naiveté in this matter is NOT exceptional, even gun buyers themselves know little of the system, thinking it’s good when in fact it is indeed a lie.
I sold guns for 8 years, I’ve seen it all.
And on several occasions when I refused to sell a gun to an obvious straw purchaser (mostly gang bangers girls), the cops didn’t do a thing because they knew no prosecution would follow, and in some cases I was told by the cops that the prosecutor told them NOT to pursue the issue.
      You have no idea.

Big Al, you are spot on. All people need to do is look at the statistics. Over the last few years, dating back to the Obama administration also, about 60-65,000 people were denied the ability to purchase a gun based on the NICS background check. Of these, consistently, less than 100 are ever prosecuted. Certainly there are some mistakes, but that is a prosecution rate of about 1/10 of 1%. Even the FBI admits that about half the denials are for felonies and other valid reasons. All the while we dealers have all the information that is needed to go right ot their residence and make an arrest

  • BRAD Lane January 25, 2020, 2:07 am

How do you call yourself a” American writer, author and civil- and political-rights activist “? The current system is not designed to find but to notify dealer that purchase is not allowed. Now the most important thing about this is that no matter which way you view it, it is unconstitutional period….. “Shall not be infringed” is pretty cut and dry. any gun law is unconstitutional.
i don’t consider myself a bad guy. i was a PA concealed permit holder, traveling for work with my gun locked in the center console. i was stopped in Nazi NY for having an out of state tag. Needless to say, i was a guest of NYDOC for 3 years. Still my only felony and not considered illegal in 48 states, i cannot pass a background check, making me one of your “really” bad guy’s. Horse shit !! I continue to carry everyday and have what i consider a nice collection. i also do gunsmith service for select, discrete shooters. No check system or registration of any kind will ever keep guns away from criminals. it only allows the upper class control over citizens trying to do the right thing.

    • JR Hutto January 26, 2020, 6:34 pm

Maybe you aren’t a “bad guy” but just the same, you broke the law. Regardless how dumb you and everyone else thinks it is, here’s your sign.

  • Earl Haehl January 24, 2020, 11:41 am

Thank you, Wayne La Pierre and the NRA lobbyists for the compromise on “instant check.”

  • Mario Acevedo January 24, 2020, 9:38 am

Good post. I’m taking a course on “gun violence” prevention from the John Hopkins School of Gun Policy and Research (Bloomberg’s academic minions) and they admit that universal background checks produce “no protective effects.” In other words, they don’t work. Yet they keep quiet on that fact.

“But ever since the presidency changed, the nation has learned how much one side perpetually lies.”

Yes, they have. That along with the hypocrisy so many in the GOP have shown (simple question of how everyone would react if any democrat, or God forbid Obama, did/said some of the things Trump has done/said) has permanently damaged the credibility of every conservative. There probably won’t be another Republican president for a generation, and anytime any conservative tries to base an argument on “morals”, “ethics”, or “Christian Values” the other side is just going to laugh itself silly and say “Trump”.

Do I care what the extreme Left thinks. Of course not. But we need the more moderate middle of the country if we want to prevent an erosion of our 2A rights. Neither side can govern with the 30% or so of their base. You need to sway the middle to your side, or you lose. That has become increasingly difficult with the constant lies and nonsense coming from the Whitehouse.

    • Glen Plake January 27, 2020, 9:31 am

I’m not sure you’ve thought this out. Your choice in the U.S. is a Republican or a Democrat. I know you’d like to wish that weren’t true, but it is and we have to live in the real world.

A vote for a Democrat will NEVER be better than a vote for a Republican when it comes to the 2A, especially since–and remember this–the President nominates Supreme Court justices who serve for decades beyond that president’s term. It doesn’t mean Republicans are great on the 2A, but Democrats NEVER are.

Be a little more practical despite your hate for Trump.

    • Big Al January 27, 2020, 11:14 am

You lost me early, and your inclusion of “Christian values” is laughable.
I see you as another one of those who thinks yours is the ONLY way of life.
Hard to see with your head up your nether regions, isn’t it?

  • Robert Lee January 24, 2020, 8:46 am

Allow me to be the first to say right on… and I don’t mind dating myself with that phrase. It is all about communist sense gun laws. Once they get them we can board the trains for the gulags. Listen to project Veratias latest recordings from the Bernieites…

I have more than one suppressor. The time required for the Feds varied from 4 months to 6 months. I hear rumors of a year currently. When acquiring my first , the salesman pined for the days of a month . I wish for the day when I just buy one off the shelf. Who was in charge when the process was a MONTH! Just sayin.
