Biden Administration Moves to Reinstate UN Small Arms Treaty that Trump Nixed

GunsAmerica readers might remember when former President Donald Trump backed out of the United Nations Arms Trade Treaty at the NRA show in 2019. The move was hailed as a reaffirmation of national sovereignty and a commitment to keeping European bureaucrats out of U.S. gun policy.

Now, it looks like the Biden Administration is working to put U.S. gun owners under international control.

William Malzahn, a U.S. State Department official at the Office of Conventional Arms Threat Reduction, assured his European counterparts at a recent conference that the Biden Administration remains committed to “strong and effective” controls on conventional arms, according to a transcript obtained by Breitbart News:

I have come from Washington D.C. this week to take the floor on the agenda item Treaty Universalization to underscore the continuing commitment of the United States to responsible international trade in conventional arms.  The United States has long supported strong and effective national controls on the international transfer of conventional arms, and the Arms Trade Treaty is an important tool from promoting those controls internationally.

The National Rifle Association warned back in 2013 that the treaty would impose a registration scheme on imported firearms by requiring each state party to maintain “national records” on the “end users” of imported firearms “for a minimum of ten years.”

The Obama administration made the treaty a priority, but it remained inoperative because the U.S. Senate never gave its approval.

Still, Obama’s Secretary of State John Kerry had signed the treaty, which prompted President Trump to revoke that signature in 2016. “We will never surrender American sovereignty to anyone,” Trump said during his NRAAM address that year. “We are taking our signature back.”

This latest move by the Biden Administration could indicate that Secretary of State Antony Blinken plans to sign it once again.

If that happens, it’s highly unlikely that the Senate will agree to ratify. The Constitution requires two-thirds of the Senate (67 members) to approve any treaty signed by the president or secretary of state. Since Democrats only hold a one-vote majority, they would need 17 Republicans to join them in signing.

President Biden has been mostly stymied in his attempts to restrict Second Amendments rights domestically. The Bureau of Alcohol, Tobacco, Firearms, and Explosives is set to adopt rules redefining “firearms” and banning arm braces, but the Democrat-controlled Congress has failed to pass any of Biden’s other agenda items.

In his recent weeks, however, the administration has worked to restrict firearms and ammunition imports, a sector where the White House has more power to act unilaterally. Biden’s officials announced last month new sanctions on Russian ammunition, which could dry up supplies from that country if they are not lifted within the next few years.

This is not Biden, Biden is nothing but a hand puppet, The European Bureaucrats you talk about have a name,
Builderberg, their money flow is to people like George Soros and Dianne Feinstein who support everything that is un-American. Trying to take contol of 2A issues is just another attemp to gain control over America. The real problem is the Builderberg Group and their powerful attemps to take contol. The American People must wake up and realize the Democrats are not the “Democrats” that we knew a few years ago. They are the Marxist Democrats or even better the “Builderberg Democrats” Because of “GREED” The European elites funnel money into the pockets of Democrats that are willing to sell out their country. Biden is a perfect example, as is Harris, Klien, Rice. Their mission, “allow the takeover of America. But first, the guns got to go.
They are afraid of us, They don’t know what it means to be American. Its like trying to put a tiger in a cage, but the tiger has a gun, got to get the gun from the tiger!

Since when did this ignorant ass, like his predecessor Obama, make or approve treaties? That’s the job of Congress! Biden already trampled on The Constitution with his “work around” of SCOTUS on the eviction extension EO! Of course he’s not impeachable, what with Willy’s punch board first in line for the presidency!

Everyone, and I mean Everyone I’ve heard, is Not seeing the Big Picture of what’s going on.
All of the detrimental policies being put forth and enacted are meant to achieve One goal: the weakening & reduction of America to facilitate its absorption into the New World Order.

Unfortunately, everyone is focused on individual events. “Oh, Biden is senile & incompetent after what he did in Afghanistan. It’s just awful!” Yes, but don’t you see that Dementia Joe was Never in charge calling the shots. He is a puppet on a string. He was ordered to do what he did in Afghanistan. Just that one catastrophe has done incredible damage in every regard to our country. Speaking of catastrophes, how about the multi-trillions in deficit spending for Progressive-Socialist programs that’s on the table? That will put us into a financial tailspin from which there will be no recovery. Again, to weaken and diminish the USA.

When the breaking point is reached, and people are ready to take up arms to save the Republic, will those arms even be around? The whole idea behind the Left’s “gun safety” push. They know that as they get further and further into “fundamentally transforming” the country, there will eventually be open revolt.
That’s why they had a dry run in the Jan. 6 aftermath to see if they could get the military to bow to their commands. That’s why they’ve infested the military with Leftist commanders who would have no trouble killing their fellow Americans. You know, those “extremist insurrectionists” who want to destroy “our democracy.” Giving the UN a say in our national firearms policy is simply a natural step forward for the Progressive-Socialists and their goals.

He can’t quite implement it in its entirety – only the Senate can approve of treaties, and the ditching of Chipman proves that the pro-2d Amendment majority, thin as it is, still exists. And I’d expect the stomach for approving of anything-UN is even less.

  • Alex September 10, 2021, 10:24 am

“As a result of a decision in 1832 by the United States Supreme Court, then president Andrew Jackson reportedly said, “[Chief Justice] John Marshall has made his decision, now let him enforce it.”1 Such audacity appears to have been based on the general understanding that courts have no effective means of independently enforcing their decisions.”

Still true today. Goddam liberal lawyers are not going to run our country into the ground. My oath has no expiration date – not as lean, just as mean, and and still a United States Marine.

    • J Franks September 12, 2021, 1:23 am

Tough talk but that’s all it is and all it’s ever going to be. I’ll tell you how I know. You’re posting here and probably Facebook not out in the world actually doing what needs doing.

The time for talk is over. Three options remain. The first is bleating like sheep and then accepting the bolt to the forehead. That’s what most of us are going to do. The second is to stop complying with your master’s wishes and departing from society. The third option is armed rebellion. If you’re still a badass Marine who still holds to his oath you need to get off the internet, pick up your rifle, and defend this country from those that wish to harm it.

We all know you’re not going to go after the Bloombergs and Koch brothers of this country. You’ll posture and rail online then meekly surrender the last bit of illusionary freedom.

  • Nicholas September 10, 2021, 10:07 am

I have a question that maybe some day, someone will answer. I’ve asked numerous times in different ways. Perhaps the author of this or whoever reviews the comments before posting might answer.
The original Constitution commands that there be Militia in each State that operates with the power “to execute the Laws of the Union, suppress Insurrections, and repel Invasions”. It operates under statutory authority detailing its form and function with the powers listed at Article I, § 8, Cl. 15. By the power listed in the original Constitution, that authority also prohibits the formation of agencies such as the FBI and ATF.
To warn public officials that the powers and authorities belonging to the People are not denied or deflated by acts contrary to the rule of Law, the Bill of Rights was added as an exclamation to what already existed in the original Constitution by function of our form of government. The Bill of Rights simply echoes what already existed. The 2nd amendment simply confirmed that “A well regulated Militia” operating under the acts and statutes was the tool the People had to control public officials and maintain freedom.
The question is why, with the myriad of statutes defining the operation of a LEGITIMATE Militia in the U.S., do so many deny and disparage its validity, and demote it to some nonsensical operation of a bunch of people running around in the woods, shouting “individual right”, with no constitutional authority to execute the laws that the Constitution commands?

    • Shanz September 12, 2021, 3:58 pm

Here here! I would like an answer to your question too. Will GOA do an article on that?

  • Abby Normal September 10, 2021, 9:57 am

  • MIke S. September 10, 2021, 9:19 am

That demented ol’ jackass in the Atlanta White House can sign anything he wants. It won’t matter. But he’d better do it fast. His days of being “in charge” are numbered.

    • Mark September 10, 2021, 11:23 am

First of all, the “demented ol’ jackass” ISN’T in charge. Whoever is pulling his strings is; he’s not even aware enough to keep his instructions private — “I’m not supposed to take questions . . . .” But, do you really want him removed? You think a President Kamala Harris (or even worse Nancy Pelosi) would be better? No, the solution is to make him irrelevant and ineffective by stopping all his stupidity in the courts and (hopefully) in Congress. Then elect large conservative (note I said Conservative, not Republican (or RINO)) majorities in the House and Senate next year, and then in 2024 make “Uncle Joe” the worst one-term president in US History, relegating Jimmy Carter to #2.

      • kb31416 September 10, 2021, 1:28 pm

        What Mark said.
The illegitimate presidential usurper is simply the puppet, and the puppeteers don’t care who is at the other end of their strings.

      • Stan d. Upnow September 10, 2021, 2:13 pm

Yup. The horrendous progression of command, if Obiden is removed, was well planned. Neither Harris nor Pelosi as POTUS is tolerable. If Dementia Joe stops serving his purpose, however, he’ll have an unfortunate “accident,” like falling down a flight of stairs and breaking his neck.

Biden can sign it, but without Senate Ratification by 2/3rds vote of approval he CANNOT enforce it!

  • Charles September 10, 2021, 7:42 am

We need another whole office, in the State Dept? to figure out how to implement gun control? The Swamp Monster REALLY is alive and well. We are worse off now than we were when we revolted against England!

  • Recce1 September 10, 2021, 7:06 am

So the question is, what happens if a President signs the Small Arms treaty and it’s ratified by the Senate? Could the President then use the treaty to curtail or eliminate the 2nd Amendment rights of citizens?

The Sovereignty Clause of the Constitution, Article 6, Clause 2, states that, “This Constitution, and the Laws of the United States WHICH SHALL BE MADE IN PURSUANCE THEREOF; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

What precisely does the clause mean? Does it mean ANY law or ANY treaty SHALL become the supreme law of the land? For instance, if the US government agreed to a treaty that said ANY criticism of Islam or Muslims constituted a hate crime, would it be enforceable and thus would the FIRST Amendment be null and void? If a treaty said that anyone accused of domestic terrorism must be turned over to an international tribunal, would it be legal, thus nullifying Due Process of the 5th through 7th Amendments?

The correct exegetical interpretation has always been based on the phrase, “WHICH SHALL BE MADE IN PURSUANCE THEREOF.” Thus ALL laws and treaties MUST NOT violate ANY section of the Constitution – PERIOD. BEFORE an above referenced law against free speech or Due Process could be implemented, the STATES of the USA would have to rescind or revise the 1st Amendment or the 5th through 7th Amendments according to Article 5 of the Constitution.

    So does this principle apply to the SECOND Amendment? Let’s look at what and why Justice Joseph Story, who was appointed to the SCOTUS by Pres. Madison, wrote that;

“The importance of this article (2nd Amendment” will scarcely be doubted by any persons, who have duly reflected upon the subject. The militia is the natural defense of a free country against sudden foreign invasions, domestic insurrections, and domestic usurpations of power by rulers. It is against sound policy for a free people to keep up large military establishments and standing armies in time of peace, both from the enormous expenses, with which they are attended, and the facile means, which they afford to ambitious and unprincipled rulers, to subvert the government, or trample upon the rights of the people. The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of a republic; since it offers a strong moral check against the usurpation and arbitrary power of rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them.”

In short, Justice Story was saying that without the 2nd Amendment the other Nine Amendments could not be defended. That’s what it comes down to. The primary purpose of the 2nd Amendment is to prevent tyranny by our own government(s), federal, State, or local.

Let’s put this all in perspective. Say a President signs the Treaty and the Senate ratifies it. Then say a President attempts to use it to curtail the 2nd Amendment rights of citizens, including banning the manufacturing of firearms or ammunition. Then people would be justified, if not obligated, to remove such a President if Congress didn’t impeach and convict him or her. By that, I’m directly referring to Jefferson’s watering of the Tree of Liberty. Otherwise, the Republic, the Great American Experiment would be a failure.

Strong words? ABSOLUTELY, but needed as we’re living in a time where some would end what’s left of a Republic with an exegetically interpreted Constitution and a free market capitalist economy.

  • Pete Farris September 10, 2021, 5:45 am

The important part of gun control is the word “control.” No other country in the world has our Bill of Rights. No other country in the world has free speech. How much of our Constitution is Biden willing to surrender to the U.N.? Political parties are unimportant. No elected official should be allowed to remain in office who, in derogation of their oath, would subject our freedoms and way of life to the U.N.– or any other foreign body.

  • Rob Johnson September 10, 2021, 5:33 am

1, it’s time to turn the U.N. out to pasture , shove the Geneva convention and Rules of engagement so far up whoever’s arse it doesn’t matter as long as they’re gone! Biden’s just like a taliban terrorist, they both want to change the roots and foundations our country has rocked for 240 + years . This crack pot and his demons must be exorcised and how about setting an example for a change joe, HAVE YOUR SECRET SERVICE BE THE FIRST TO SET THE EXAMPLE BY DISARMING THEMSELVES OF ALL GUNS ! Mr.Michaels your article was a love hate , I love your style and obviously hate what you had to write about!

  • Bobby September 10, 2021, 5:16 am

First you need international need to curb country’s like Somalia, Syria. Afghanistan, Iraq before coming to US to dictate to Americans. Idiots in Washington fix the judicial system penalties on gun violence first not the guns

Just another very clear example that the Communists – er, I mean the Democrats – have nothing but contempt for our Constitution and the rights of our citizens. Z

    • Jrp September 10, 2021, 6:16 am

Well said. Just good ole communists. It’s a communist playbook. We are watching the downfall of the United States by people “placed” in power not elected. Stalin said it’s who counts the votes that matter.

    • Clint W. September 10, 2021, 10:21 am

Please, in any reference to what was labelled the Democrat Party, now use the word Communist. That is what they are, communism is what they want, so in conversation, always refer to them as such. Just read their party platform, it is not only communist based, it resembles the laws and regulation that Adolph wanted for his country 85 years ago. The old kids taunt of, “I’m rubber, your glue, whatever you say (in this case accuse me of) bounces off me and sticks to you” is applicable anytime a Communist calls a Conservative (and most Republicans) a Nazi.
