Biden Administration Moves to Reinstate UN Small Arms Treaty that Trump Nixed

GunsAmerica readers might remember when former President Donald Trump backed out of the United Nations Arms Trade Treaty at the NRA show in 2019. The move was hailed as a reaffirmation of national sovereignty and a commitment to keeping European bureaucrats out of U.S. gun policy.

Now, it looks like the Biden Administration is working to put U.S. gun owners under international control.

William Malzahn, a U.S. State Department official at the Office of Conventional Arms Threat Reduction, assured his European counterparts at a recent conference that the Biden Administration remains committed to “strong and effective” controls on conventional arms, according to a transcript obtained by Breitbart News:

I have come from Washington D.C. this week to take the floor on the agenda item Treaty Universalization to underscore the continuing commitment of the United States to responsible international trade in conventional arms.  The United States has long supported strong and effective national controls on the international transfer of conventional arms, and the Arms Trade Treaty is an important tool from promoting those controls internationally.

The National Rifle Association warned back in 2013 that the treaty would impose a registration scheme on imported firearms by requiring each state party to maintain “national records” on the “end users” of imported firearms “for a minimum of ten years.”

The Obama administration made the treaty a priority, but it remained inoperative because the U.S. Senate never gave its approval.

Still, Obama’s Secretary of State John Kerry had signed the treaty, which prompted President Trump to revoke that signature in 2016. “We will never surrender American sovereignty to anyone,” Trump said during his NRAAM address that year. “We are taking our signature back.”

This latest move by the Biden Administration could indicate that Secretary of State Antony Blinken plans to sign it once again.

If that happens, it’s highly unlikely that the Senate will agree to ratify. The Constitution requires two-thirds of the Senate (67 members) to approve any treaty signed by the president or secretary of state. Since Democrats only hold a one-vote majority, they would need 17 Republicans to join them in signing.

President Biden has been mostly stymied in his attempts to restrict Second Amendments rights domestically. The Bureau of Alcohol, Tobacco, Firearms, and Explosives is set to adopt rules redefining “firearms” and banning arm braces, but the Democrat-controlled Congress has failed to pass any of Biden’s other agenda items.

In his recent weeks, however, the administration has worked to restrict firearms and ammunition imports, a sector where the White House has more power to act unilaterally. Biden’s officials announced last month new sanctions on Russian ammunition, which could dry up supplies from that country if they are not lifted within the next few years.

That will put us into a financial tailspin from which there will be no recovery. Again, to weaken and diminish the USA.

    When the breaking point is reached, and people are ready to take up arms to save the Republic, will those arms even be around? The whole idea behind the Left’s “gun safety” push. They know that as they get further and further into “fundamentally transforming” the country, there will eventually be open revolt.
    That’s why they had a dry run in the Jan. 6 aftermath to see if they could get the military to bow to their commands. That’s why they’ve infested the military with Leftist commanders who would have no trouble killing their fellow Americans. You know, those “extremist insurrectionists” who want to destroy “our democracy.” Giving the UN a say in our national firearms policy is simply a natural step forward for the Progressive-Socialists and their goals.

    He can’t quite implement it in its entirety – only the Senate can approve of treaties, and the ditching of Chipman proves that the pro-2d Amendment majority, thin as it is, still exists. And I’d expect the stomach for approving of anything-UN is even less.

    I have a question that maybe some day, someone will answer. I’ve asked numerous times in different ways. Perhaps the author of this or whoever reviews the comments before posting might answer.
    The original Constitution commands that there be Militia in each State that operates with the power “to execute the Laws of the Union, suppress Insurrections, and repel Invasions”. It operates under statutory authority detailing its form and function with the powers listed at Article I, § 8, Cl. 15. By the power listed in the original Constitution, that authority also prohibits the formation of agencies such as the FBI and ATF.
    To warn public officials that the powers and authorities belonging to the People are not denied or deflated by acts contrary to the rule of Law, the Bill of Rights was added as an exclamation to what already existed in the original Constitution by function of our form of government. The Bill of Rights simply echoes what already existed. The 2nd amendment simply confirmed that “A well regulated Militia” operating under the acts and statutes was the tool the People had to control public officials and maintain freedom.
    The question is why, with the myriad of statutes defining the operation of a LEGITIMATE Militia in the U.S., do so many deny and disparage its validity, and demote it to some nonsensical operation of a bunch of people running around in the woods, shouting “individual right”, with no constitutional authority to execute the laws that the Constitution commands?

Whoever is pulling his strings is; he’s not even aware enough to keep his instructions private — “I’m not supposed to take questions . . . .” But, do you really want him removed? You think a President Kamala Harris (or even worse Nancy Pelosi) would be better? No, the solution is to make him irrelevant and ineffective by stopping all his stupidity in the courts and (hopefully) in Congress. Then elect large conservative (note I said Conservative, not Republican (or RINO)) majorities in the House and Senate next year, and then in 2024 make “Uncle Joe” the worst one-term president in US History, relegating Jimmy Carter to #2.

    So the question is, what happens if a President signs the Small Arms treaty and it’s ratified by the Senate? Could the President then use the treaty to curtail or eliminate the 2nd Amendment rights of citizens?

    The Sovereignty Clause of the Constitution, Article 6, Clause 2, states that, “This Constitution, and the Laws of the United States WHICH SHALL BE MADE IN PURSUANCE THEREOF; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

    What precisely does the clause mean? Does it mean ANY law or ANY treaty SHALL become the supreme law of the land? For instance, if the US government agreed to a treaty that said ANY criticism of Islam or Muslims constituted a hate crime, would it be enforceable and thus would the FIRST Amendment be null and void? If a treaty said that anyone accused of domestic terrorism must be turned over to an international tribunal, would it be legal, thus nullifying Due Process of the 5th through 7th Amendments?

    The correct exegetical interpretation has always been based on the phrase, “WHICH SHALL BE MADE IN PURSUANCE THEREOF.” Thus ALL laws and treaties MUST NOT violate ANY section of the Constitution – PERIOD. BEFORE an above referenced law against free speech or Due Process could be implemented, the STATES of the USA would have to rescind or revise the 1st Amendment or the 5th through 7th Amendments according to Article 5 of the Constitution.

    So does this principle apply to the SECOND Amendment? Let’s look at what and why Justice Joseph Story, who was appointed to the SCOTUS by Pres. Madison, wrote that;

    “The importance of this article (2nd Amendment” will scarcely be doubted by any persons, who have duly reflected upon the subject. The militia is the natural defense of a free country against sudden foreign invasions, domestic insurrections, and domestic usurpations of power by rulers. It is against sound policy for a free people to keep up large military establishments and standing armies in time of peace, both from the enormous expenses, with which they are attended, and the facile means, which they afford to ambitious and unprincipled rulers, to subvert the government, or trample upon the rights of the people. The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of a republic; since it offers a strong moral check against the usurpation and arbitrary power of rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them.”

    In short, Justice Story was saying that without the 2nd Amendment the other Nine Amendments could not be defended. That’s what it comes down to. The primary purpose of the 2nd Amendment is to prevent tyranny by our own government(s), federal, State, or local.

    Let’s put this all in perspective. Say a President signs the Treaty and the Senate ratifies it. Then say a President attempts to use it to curtail the 2nd Amendment rights of citizens, including banning the manufacturing of firearms or ammunition. Then people would be justified, if not obligated, to remove such a President if Congress didn’t impeach and convict him or her. By that, I’m directly referring to Jefferson’s watering of the Tree of Liberty. Otherwise, the Republic, the Great American Experiment would be a failure.

    Strong words? ABSOLUTELY, but needed as we’re living in a time where some would end what’s left of a Republic with an exegetically interpreted Constitution and a free market capitalist economy.

    The important part of gun control is the word “control.” No other country in the world has our Bill of Rights. No other country in the world has free speech. How much of our Constitution is Biden willing to surrender to the U.N.? Political parties are unimportant. No elected official should be allowed to remain in office who, in derogation of their oath, would subject our freedoms and way of life to the U.N.– or any other foreign body.

      Rest assured, DJ… you’re not the only one who holds to the oath. I swore to support and defend the Constitution of the United States against ALL enemies, foreign and DOMESTIC (emphasis mine). Not as young and capable as I once was, but can still manage to stand on my own two feet, and am still pretty efficient at operating my “gear”.
