BREAKING: Bipartisan Gun Deal Reached!

Breaking news!  A bipartisan group of senators reached an agreement on a new gun bill Thursday aimed at improving the FBI’s background check system.

Known as the Fix NICS Act, the legislation is designed to ensure federal and state authorities are submitting relevant mental and criminal history records to the FBI’s National Instant Criminal Background Check System (NICS).

Sponsors of the bill include some real heavy hitters on both sides of the gun divide.  We’re talking, John Cornyn (R-TX), Chris Murphy (D-CT), Tim Scott (R-SC), Richard Blumenthal (D-CT), Orrin Hatch (R-UT), Dianne Feinstein (D-CA), Dean Heller (R-NV), and Jeanne Shaheen (D-NH).

“For years agencies and states haven’t complied with the law, failing to upload these critical records without consequence,” Sen. Cornyn said in a press release. “Just one record that’s not properly reported can lead to tragedy, as the country saw last week in Sutherland Springs, Texas.

The senator is referring to the fact that the shooter at the church in Sutherland Springs had a documented history of domestic violence while serving in the Air Force. He cracked the skull of his infant stepson in addition to beating his former wife.

Had that been reported, the gunman would’ve been designated a prohibited person.  And, thus unable to purchase a firearm at an FFL or gun store.  It’s not clear why the Air Force failed to turn those records over to the FBI.

“This bill aims to help fix what’s become a nationwide, systemic problem so we can better prevent criminals and domestic abusers from obtaining firearms,” Cornyn concluded.

Bullet points for the Fix NICS Act:

  • Requires federal agencies and states to produce NICS implementation plans focused on uploading all information to the background check system showing that a person is prohibited from purchasing or possessing firearms under current law—including measures to verify the accuracy of records.
  • Holds federal agencies accountable if they fail to upload relevant records to the background check system through public reporting and prohibiting bonus pay for political appointees.
  • Rewards states who comply with their NICS implementation plans through federal grant preferences and incentives, while increasing accountability through public reporting for those who do not comply with their plans.
  • Reauthorizes and improves important law enforcement programs to help state governments share relevant criminal record information with NICS.
  • Creates a Domestic Abuse and Violence Prevention Initiative to ensure that states have adequate resources and incentives to share all relevant information with NICS showing that a felon or domestic abuser is excluded from purchasing firearms under current law.
  • Provides important technical assistance to federal agencies and states who are working to comply with NICS record-sharing requirements.

“This deal will strengthen the background check system and save lives. Our bill marks an important milestone that shows real compromise can be made on the issue of guns. I’m grateful that Senator Cornyn was such a strong partner and straightforward negotiator,” said Sen. Murphy.

“It’s no secret that I believe much more needs to be done. But this bill will make sure that thousands of dangerous people are prevented from buying guns,” Murphy added. “It represents the strongest update to the background checks system in a decade, and provides the foundation for more compromise in the future.”

At first blush, there’s nothing too objectionable in the bill.  The National Shooting Sports Foundation, the firearms industry trade organization, has been pushing a Fix NICS campaign for years.  It appears that this new bill was crafted with that in mind.

I reached out to the NSSF for comment.  Should hear soon as to whether they give it the thumbs up or down.

“We commend Sen. Cornyn for his leadership to encourage state and federal agencies to enter all applicable records in the FBI’s National Instant Criminal Background Check System (NICS),” said Lawrence G. Keane, Senior Vice President and General Counsel for the National Shooting Sports Foundation. “This legislation will provide states with the necessary resources to promptly and efficiently provide disqualifying records to NICS on those who are prohibited under current law from possessing firearms. Federally licensed firearms retailers rely upon NICS to prevent the sale of firearms to prohibited persons. This legislation will fix NICS so that background checks are accurate and reliable.”

“The Sutherland Springs, Texas, mass shooting was another deadly reminder that the criminal background check system is only as good as the records it contains. This bipartisan legislation is an important first step to improve the background check system, and keep guns out of the hands of domestic abusers and criminals,” said John Feinblatt, the president of Everytown for Gun Safety. “A majority of mass shooters in this country have histories of domestic violence, and we’re glad that Sens. Cornyn and Murphy are working in a bipartisan way to address gaps in the background check system that allow people with dangerous histories to obtain firearms.”

    Let’s say I have this cake. It is a very nice cake, with “GUN RIGHTS” written across the top in lovely floral icing. I received it from the 2nd amendment and the Dick act of 1902.

    Along you come and say, “Give me that cake.” I say, “No, it’s my cake.” You say, “Let’s compromise. Give me half.” I respond by asking what I get out of this compromise, and you reply that I get to keep half of my cake.

    Okay, we compromise. Let us call this compromise The National Firearms Act of 1934.

    There I am with my half of the cake, and you walk back up and say, “Give me that cake.”

    I say, “No, it’s my cake.”

    I’m left holding crumbs of what was once a large and satisfying cake, and you’re standing there with most of MY CAKE, making anime eyes and whining about being “reasonable”, and wondering “why we won’t compromise”.

    I’m done with being reasonable, and I’m done with compromise. Nothing about gun control in this country has ever been “reasonable” nor a genuine “compromise”.

    Stinks, stinks and stinks some more! The Federal government failed us so now they want to act like they’re doing something to correct it! Ya, when cows fly. How about just enforcing accountability for not following existing laws?? This is the opening that all the globalist, democrat commies want, now just sit back and wait for it, the fact that government is in control on who gets on the list and or probably never off of it! I know that a friend got labelled a domestic abuser by protecting himself from an attack from his wife while sleeping so he was labeled, she even admitted it. Or how about all the cases of people getting put on the no fly list that were kids and some people that have never flown before! The government is and always has been the source of most of the problem not the fix!

    It is felony to lye on a form 4473. It is not unknown that a buyer will do this, get rejected by the investigating agency, not be reported by the seller and walk away free. I know of a case where this was witnessed and the attempted buyer was a felon. The sad truth is the BATFE has been reported to fail to prosecute the ones that they know of. The system is broke. This administration should correct this.

    Watch what actually happens when the “regulators” get this. They’ll use it to track everyone that buys then everyone that owns a firearm. They’ll all be on file. Just like the UK and Australia.     That’s the quote that worries me. It is as usual; the left gains a little ground and plans for the next “compromise”, as they chisel away at our Constitution. I agree that anyone CONVICTED of domestic violence should be banned from buying a gun, but that is already the case. Why pass more laws to force the enforcement of existing laws? Why not just go after the agencies that AREN’T enforcing the law?

      Right or Left, you can be too casual in allowing a Nics check that doesn’t contain all of the information that is readily available from ALL sources, to prevent a “wing-nut,” from purchasing firearms. My firearm buddies and I have absolutely no reason to believe that this, “in depth,” full report of an individual’s persona to be revealed prior to allowing him/her to purchase a firearm, would hurt us at all.
      However, there is an awful lot of “Black Market,” trade of weapons that needs to be addressed, but in my opinion, it is just something we law abiding gun owners have to live with right now. But that is another (important,) issue.

    The main problem with this whole bill is reporting. While I’m all for keeping firearms out of the hands of violent mentally ill people, who will make the decision over who is violent? The only way I can conceive of making sure that a person, at the time of purchase through a FFL (private purchases will still happen regardless of the laws) is not mentally impaired to own a firearm is if he/she has recently gone through some type of psychological exam and is “certified” as safe to purchase. We all know how that invasion won’t be tolerated by a majority of people. But there is simply no other way of knowing without perhaps a previous mental health / DV reporting to the NICs data base. How do we know the purchaser has not fully recovered from a mental illness? How do we know if he/she was wrongfully accused of a DV or wrongfully diagnosed with some type of mental illness? There’s no way of knowing a person’s mental state without doing an up to date psychological exam – and even that can be hugely subjective. A determined crazy person who wants a firearm could simply say the right things during a mental health exam and be checked off as “safe” to purchase. To me, bottom line is there is no way of knowing 100%. Moreover, although we would all likely say that any mass murderer is obviously crazy, it does not take a “crazy” person to commit a mass murder of people – i.e. terrorists. Any (unknown) terrorist who is a US citizen legally allowed and “certified as safe” to own a firearm could buy one (or many) and shoot up a nightclub, church, concert, shopping mall, etc. and he/she doesn’t necessarily have to be “crazy”, right? – pretty much just some type of over-zealous believer in his/her cause. Liberals will argue that whatever action we can do will stop someone somewhere, but there’s no way of knowing that. Prime example: Timothy McVeigh didn’t need a gun and he bombed and killed 168 people and injured 680 and he was “certified” as having NO major mental illness at the time of his trial. There’s just no way of knowing.

      That was my first thought as well. All of these are bureaucrats, so why do they need another law telling them to follow the law they are already supposed to follow? This is their actual job! My company would have little reason to not fire me if I didn’t do my job, or if I’m unable, then telling my boss as soon as I know so that he can get me help. I’m of mixed thoughts on the states bit of it with incentives. Given that background check laws already break the entire concept of the federal and state governments, I’m not sure how I’d want it implemented.

The 1994 Congressional investigation made clear that the BATF\’s actions at Waco should have been the coup de grace for it, but it\’s still around, still unilaterally and arbitrarily making law-by-regulation.

    For those misguided gun owners who parrot the oft repeated “universal background” silliness I would ask who is it who will define the perimeters by which the rules of the game are defined. So as with everything else in the era of big government, we will witness the playing field shrink on a regular basis until the once expansive field we once had will be reduced to the size of a pickup bed. NO EXCUSE WILL BE IGNORED until we will see Class Three type registration enacted for air guns . . . Then it will all be gone and we the law abiding citizen will be thrown like a piece of meat to the lawless mobs to beg for mercy from the unmerciful. There! All cheered up now?     Federal law has required federal,state and local agencies to report felony and domestic violence arrests to NCIC for decades. Why do incentives have to be provided to these agencies to comply with already existing laws. I think penalties for not reporting what is already required need to be applied. As has been said many times in the past, “the worst law breakers are governments”.

They are going to pass some sort of law about it. The issue is then WHO is going to decide who is mentally deficient? IF all of the sudden some left wing wack jog takes control again we are in trouble! If you like to shoot guns for a past time are you going to be deemed a risk? And have your rights revoked??? Think about it sports fans, under the Obama administration people and groups were deemed terrorist risk if you were a Christian. BE CAREFUL FOR WHAT YOU ASK FOR!!!!

    While I understand the need for some group or agency to collate this necessary data, it still smells fishy. In the hands of responsible legislators, it can be for the public good, yet in the hands of agenda-driven socialist politicians, it is merely ANOTHER attempt to put their foot in the door to give the appearance due diligence and having some iota of relevance.

    The BIGGER issue here is why so many people in our society have become unglued; lost souls in a sea of legislative indifference to massive levels of voter disenfranchisement. As asswipes like Feinstein, Pelosi, and McCain (but most politicians, in general) continue their fortune amassing political careers, they leave an ever-enlarging trail of desperate voters in their wake, a wake which creates a caldron of rebellious and revolutionary reaction. Politicians pad their own nest and then expect a disgruntled and often angry populace to just accept their servile lot in life. Where are voices of resistance in the House of Congress? We hear a small handful of brave legislators extoll the evils of the Federal Reserve, Israel’s and corporations’ stranglehold on our government, yet the majority (and we know who they are) continue to treasonously allow foreign entities to subvert our system of government.

    THAT is the reason we are even having this discussion in the first place, yet no one dares discuss the elephant in the room.

    I fear this is a lost opportunity for national CCW. It seems to make sense that a deal to ensure existing laws are followed (data base updated), that a nationwide (central) system be created. Such a central DB would be in the ideal position to issue the national CCW permits.

    So there are laws that exist that state federal agencies must report individuals who are not qualified to buy firearms.

    I guess I would say that who cares about the new laws then? If you can’t enforce existing laws, who cares about new laws. What a bunch of brain dead dolts. The lot of them need to be fired and replaced with horse poop. It would have more use in life than the crap they are shoveling now. The people in Congress actually wonder why a majority of voting people think they are useless and their approval rating is less than 20%. Yes let’s reward more bad behavior.

      Everyone in Texas knows Cornyn is a RINO and only becomes a conservative at election time. Unfortunately, no one is able to primary him. I have voted against him in the last two primaries, but he always wins by a landslide. Same in the general election. I wish we could get a conservative in his place, but he wields too much power in Texas and the Senate.

      They will simply develop a new ATF form 4473 where you sign over and waive your HIPAA rights for medications and mental health issues. Similar to when applying for a job and waiving your privacy rights so your prospective employer can investigate your previous employment, references, credit, education, etc.

    I think it’s a good bill. I think in the wake of the mass murders, if something is done then maybe the midterm elections will still go to pro gun reps instead of enraged lefties. We can have all the opinions we want but if our reps get voted out then the anti gunners have a better chance of passing their agenda. As for being falsely accused, I’ve been there. My record showed I had a 20 yr old felony arrest but my record didn’t show the disposition. The irony was that the GBI (Ga) was the arresting agency and the GBI is who does background checks here in Ga! They didn’t give a crap about accuracy! I had to jump through some hoops to find the court records that showed the case was dismissed. So I am for this bill.

    Its not enough but a start. Adding mental illness to the database is crucial but the diagnosis must be specifically stated. Looking at mass killers of the past is the perfect place to begin. Every one has a serious mental disorder. Schizophrenia, anti social personality(psychopath), schizotyple, any psychosis, or a forced commitment should be grounds for denial and the FBI should be compelled to investigate when a purchase is attempted. At least they are looking at the person not the gun because thats where the problem is.

      They need to add a provision that a mentally ill person has to have been adjudicated as “dangerous” or ” a risk to themselves or others”. About 40% of all Americans (and not just liberals, although liberalism is a mental illness unto itself…) have or have had SOME form of mental illness at some point in their lives. Sometimes it’s only depression caused by a bad life situation. But not all people with mental illnesses are a danger, or even a “potential” danger, to themselves or others. If they start barring ALL people with SOME history of mental illness from buying or owning guns, they will have effectively disarmed (or attempted to disarm ) nearly half of all Americans – a liberal’s wet-dream, to be sure.

      You don’t know much, if anything, about buying firearms. Forced commitment is ALREADY a question that is asked when a person fills out the form to buy a firearm. Answer “yes” to that question and no firearm for you. Further: In the mind of some shrinks, anyone who wants to own a firearm is mentally disturbed. If you let the Government decide who is mentally unfit to own a firearm, the time will come when even a person who takes an antidepressant in the winter, due to lack of sunlight, will be deemed unfit to own a firearm.

    This is pointless. Of he couldn’t pass a background check he could just buy them from a private seller. There needs to be universal background checks on every gun sale period.

      First of all, I don’t think you are much of a second amendment proponent or privacy loving gun owner. And if you don’t think that the FBI and the ATF are compileing the names of gun owners you sir are very nieve. And second, how do you ever enforce so called Universal background checks?

      A back ground check on every gun purchase will only apply to law abiding citizens. What far too many people don’t seem to understand is that criminals will still obtain firearms. The FBI confiscates about 40,000 illegal firearms that are smuggled into this country every year. If you don’t believe that — ask them! They estimate that they only find about 10 percent of the firearms that are smuggled into this country. If the FBI is correct, then somewhere around 400,000 firearms a year are smuggled into this country. When firearms are finally banned in this country, I wonder how many firearms will then be smuggled in each year: Twice as many? (800,000), Four times as many? (1,200,000). The bottom line is: If criminals want firearms, someone will provide them. Won’t it be nice when only criminals have guns? The criminals can hardly waite!

      No, you’re wrong.
      The law will ‘finance’ an existing amendment.
      The Lautenberg Amendment as carried into military discharges said that, “those discharged under Other than Honorable conditions, who have a record of domestic charges, their Term of Service(not the same as discharge), will be dishonorable, under the Lautenberg Amendment.
      The purpose of this proposed legislation, once passed, will fund the increase in entry personnel, staffs, and improved data accuracy.
      The current Army/security registration is hopelessly backlogged. During conversion from an office entry system, to a local entry system, hundreds of entry clerk were fired. With the insurmountable numbers of entry errors, there was no one to check the work.
      This legislation will fund that.

    The Senators may have accomplished something, but the house will have to go and come up with their own deal. Then the two will have to work out the differences.
    But since mistakes are part of being a human, they need to have a system for addressing false record errors made in the record-keeping.

    Sounds good on the surface but then when you start looking for cracks for the liberals to attack there are too many. There needs to be protection from false accusations about mental stability and domestic violence. If you add checks and balances and actual punishments against false accusers so they won’t want to risk making a false report…. Then maybe. Let me think about it more. I’m sure I can find more sources in it to attack law abiding gun owners.

      I, too, worry about false labeling of good people. Fix this and I’ll consider supporting it. Add conceal carry nationwide and I’m in if they fix the false labeling problem.
