L.A. Law Criminalizing Possession of 10-round Magazine Set to Roll Out

If gun control is good at one thing it’s turning law-abiding citizens into unsuspecting law breakers. Case in point, an ordinance passed in Los Angeles over the summer that criminalizes the possession of magazines that hold more than 10 rounds of ammunition.

Today, those magazines are lawful property. By Thursday, Nov. 19, those magazines will be contraband, and anyone caught with one will be slapped with a misdemeanor.

Sadly, a request for an injunction on the ordinance, which would have prevented it from rolling out until the case against the ban was decided in court, was denied by Los Angeles Superior Court Judge James Chalfant this week.

“This is a victory for common sense gun violence prevention laws,” said City Attorney Mike Feuer, in reference to the judge’s decision. “The use of these magazines has so often led to tragedy. This law will help prevent those horrible events in the future.”

City leaders are instructing gun owners to turn over their magazines to law enforcement.

“The City Council banned the possession of large-capacity magazines to give law enforcement another tool to keep people safe and get these dangerous devices off the streets,” said City Councilmember Paul Krekorian, author of the law.

“Starting next week, Los Angeles will start enforcing and upholding the ban. I urge anyone currently in possession of these illegal magazines to turn them in at an LAPD station before enforcement begins,” added Kerkorian.

However, gun rights activists say the battle is not over. While they are encouraging gun owners to follow the new law, they are going to continue to pursue their lawsuit challenging the city’s mag ban.

The case is tentatively scheduled to be heard in the summer of 2016.

      Anyone; Feinstein, Brown, Bocera, Feuer, or anyone else; who claims that such policies will stop future acts is a liar unless they can prove that they can see into the future and that passage actually prevented such acts. Even then, they will also have to prove that all criminals declined to use anything larger than a 10 round magazine, and they would have to prove that a law abiding citizen intentionally went out and got a so-called “high capacity” magazine and used it in a criminal act.

    Doesn’t take much scrutiny of the video to see that this was a publicity stunt pulled together by LA Councilman Paul Krekorian. Using the typical time-tested emotional appeals which, as they enter the left ear, nudge the critical thinking skills of the ignorant and weak-minded recipient out the right ear.
    “People don’t need 100-rd magazines and AUTOMATIC WEAPONS to defend their homes.” he rants. Looking past the fact that this guy gives no sourcing for the countless hours of research he and his staff must have logged to reach the conclusion which empirically shows what type of device(s) the average person should keep on hand to be safe from harm. Notice how he seamlessly moved the goalpost? This ordinance has nothing to do with “automatic weapons,” already so tightly regulated that, unless he does a tour in the military, your average law-abiding enthusiast will almost certainly never shoot (let alone OWN) one.
    Which brings us back to our poster child, son of theFoster Family, who was killed in an attack that the passage of this law would have done absolute zero to prevent. It’s hard to call people like the Fosters out. Life, along with one or more pieces of human flotsam, has shit on them. However, if the gun used against them was fully “automatic” as they claim, and their car was hit with more than ten rounds (again, their words) then their participation in this legislation is nothing more than sound-byte material. This is NOT their fight. Worse, it makes the Fosters look like “professional mourners.”

    To be dispossed of personal property by a local ordinance is a violation of the 4th Amendment, unlawful search and seizure. LAs intent seems to be voluntary compliance. Everyone should write letters & send messages to state & local law makers as well as the tourism industry stating that you refuse to visit a state that allows a violation of your constitutional rights. The loss of tourism income speaks volumes.

    I don’t know where this concept of punishing the innocent for the actions of the guilty came into being. Foreign concept to me. Certainly is not authorized by the Constitution. First time I encountered it was in the service. Our commander punished the whole squadron because somebody broke into the vending machine in the barracks. In those days ANYONE could come on base. Since the barracks were never locked and because the squadron was away working for most of the day, there was plenty of opportunity for strangers to break into the machine. But we were all punished.

    I occasionally travel into or through Los Angeles. I will stuff an empty hi-cap mag under my seat just so I can sit smugly as I break their (LA City’s) stupid fucking law. What a bunch of libtard dumbshits. And, in response to those who rail about LA enacting laws that supersede State or Federal laws, they can. they can make laws that are more stringent, never less stringent. Look at local building codes. Many adopt the National Building Code, but many cities also modify the NBC to be more stringent. This is how we wind up living in places that have what seem like unreasonable restrictions on our life and liberty. You can only defeat the assholes that enact these sorts of insults at the ballot box. the dumbshit city attorney is an elected position, as are the city council positions. If enough LA residents voice their opinion at the next round of elections for local politicians (including judges, such as the asshole that refused to grant the injunction) then the newly elected politicians might think twice about trampling constitutional rights in the guise of political correctness and/or buckling under the pressure of libtard fools in the form of political action groups or celebrity individuals.     Are there two standards in Los Angeles, one for law enforcement officers and another for civilians? Does this new ordinance apply to LAPD officers on-duty or off. How about L.A. County deputy sheriffs and CHP troopers? How about federal law enforcement officers? Are the citizens a bunch of sheep who’ll put up with having their rights abridged by an out of control city council, dominated by radical libs?

    What is the benefit of this ordinance anyway? People will just carry two or three extra magazines. So instead of having a pistol with 15 or 16 rounds, they’ll 20 or 30 extra rounds in their spare magazines. Don’t these city council morons know it takes less than two seconds to load another magazine? I guess they will next enact an ordinance outlawing the ownership and possession of more than one magazine. It never fails to amuse me when people try to regulate something about which they are totally ignorant. It’s kind of like giving PETA the power to issue hunting licenses.

      Colorado passed the 10 round limit on magazines several years ago. However, most of the Colorado sheriffs refused to enforce it, saying it violated the 2nd amendment. The sheriff is the highest elected officer in the state (all states) on legal enforcement matters, because the the US Supreme Court held a county sheriff is the ultimate elected authority on enforcement of the law in his county. Even the FBI, Homeland, and other Federal Agencies must now get prior permission from the sheriff to enter and operate in the sheriff’s county – the sheriff’s authority trumps all federal agency’s legal enforcement (and investigations) federal businesses. (The FBI was pissed at the Supreme Court finding almost 10 years ago – but it holds.)
      So, in all states the Governor and lesser politicians have no authority over the sheriffs. The sheriffs work directly for the voters. In Colorado, nearly all the Sheriffs told the Governor that the law he signed violated the constitution and they would not enforce iit. And, the city police are under the sheriff’s authority, and the police don’t enforce it either. This US Supreme Court finding has been was followed by total silence by the Governor and his cronies, we never hear anything about the “10 rd limit law”. So, make friends with your sheriff – they are actually more powerful than the Governor and usually friendly to law-abiding shooters. Dr. J. Burnett

    When does California insist on passing gun laws in response to shootings in other states?

    It’s one thing if they’re reacting to something that happened within the state, but California already has the strictist gun laws in the nation. Some states have really loose gun laws and if a shooting happens in a state with loose gun laws it’s those loose gun laws that are the problem not lack of regulation in California.

    Using shootings in other states as a reason to pass this law is stupid because it won’t prevent a single shooting from happening again in another state.

    So how will this affect people driving through LA. I live in a county that doesn’t ban high cap mags and am driving to another County that doesn’t ban high cap mags. If I get pulled over in LA do I get arrested?

    Serious answer: I would take a picture of them, set the magazines off to the side and not get caught with them until after the case is resolved in my favor, assuming that it would be, and still keep them regardless. But, I would also send copies of the picture to the mayor and all of the council members, anonymously to protect myself, with a note that would read, “You are welcome to come kick my door in to try and take them, but rest assured that if you do, that you will be met by them along with other items that your family, friends, and neighbors will wish that you hadn’t while reflecting back to happier times in their lives, seriously”.

    The NYS Safe Act banned the AR-15; and then “grandfathered” (via mandatory registration) those currently owned – estimated to be roughly a million. Would you like guess how many New Yorkers (upstaters) registered their rifles?…33,000. My advice to anyone living in a blue state or city is keep a gun and don’t register shyt!!…It only means they will take it away from you later. If you ever have to use it, your story is you shot the dirtbag with his own gun after a scuffle. I know at least one cop who did that for a bodega owner who killed an armed robber in his store and he says most cops would do the same. In fact, they all say when a victim turns the tables on a robber and blows him away they’re glad. IGNORE THE LAW – HIDE YOUR GUNS. Rent a gun for practice at the range. Then try to move to a place that respects your right to be armed.

    If this is a misdemeanor, how does the city know who has these mags? I would not give them anything. Your property cannot be searched without a warrant. If the mag is not visible, no problem.

I read all these comments from concerned citizens about the 2nd amendment and our other rights and realize they are being infringed upon daily by the government. But, we can complain about these issues all day long. However, all the bitching in the world won’t accomplish a dam thing. I can tell you all , vote these incompetent fools out of their cozy seats in the government and lets get common sense people into the areas of the government that make sound decisions. There’s way too many laws on the books now and realistically everyone is in some way breaking some. A person would have to be a computer to remember them. It is my personal conviction based upon the precious document that we are under no obligation to obey laws known to be unconstitutional. I live in California and I will never give up my magazines or my guns. I think it is time for a revolt against these tin horn tyrants we have carelessly put into office. What can they do?     I own homes in two states that still allow (as I write this) citizens to own large capacity magazines. I urge that any Californians affected by the law send their magazines, now illegal by judicial fiat, to friends or family in a state where citizens still retain reasonable right to self defense, or better yet, bury them in their back yard. When will the honest and non-criminal citizens protest these socialist actions? If we do not organize and challenge these violations of our civil rights, ala “Black Rights Matter”, Mexican and other illegal immigrants, the Ferguson and Baltimore rioters, and the latest campus protestors, then we can only blame ourselves. Our forefathers fought for our freedoms, but apparently the silent majority in America is not willing to protest or fight to keep the American way of life. If so, we can only blame ourselves!

    So a mass shooter or thug can just carry three guns. When one is out of ammo put it away and pull out another in about one or two seconds. The lawful citizen ends up stuck with a crippled capacity magazine. Better go with 10 millimeter or a .45 Auto handgun if you live in Los Angeles (if they even allow you to have that).

    The criminals will not follow this law California. There are at least 100 million magazines that 11 or more rounds in the United States. This is about controlling the common citizen, not criminal control. It is tyranny.

    I went to visit California in July of 2015. Prior to travel, I tried my best to find a way to bring my CCW to keep at the HOME in which I was to be staying at near San Jose. Thought may be I could “Fed-Ex” it. After exploring several toons to SHIP IT there, which it would have had to be shipped from one FFL to another thre, I would till have had to be a California resident to pick it up, from my take on it? Thought about flying to Nevada, then driving. Ended up just driving all the way there from Tennessee. Every state between here and there recognized my RIGHT to carry, and upon reaching Cali, I had to place it in my case separate from my ammo. I still brought it there. Funny thing ( not really “funny”) was is that the same DAY that girl was killed by the illegal immigrant felon, I was in San Fransicko too, down near the water front. I DIDN’T SHOOT HER! And, by trying to remain “Lawful” I could not have topped it or saved anyone else if the incident unfolded like in Paris. But now, I carry ESPECIAL in “no gun zones” here in Tennessee except for court houses and police stations. EVERYWHERE else is fair game. Even now carry my AR loaded except not one chambered as is allowed here with a HCP. Shotguns, Rofles may be carried with a loaded mag as long as one is NOT chambered if you have a HCP and have a reason to believe your life could be in jeopardy. ISIS anyone?

      You can fly it to California in a locked hard sided case. I have done it several times, with pistols and AR pattern rifles, into and out of LAX and John Wayne. You are also allowed to open carry in California, but it may be that you need to be a resident, I’m not sure about that part. I know what you’re thinking, “BS”, but look it up. However, you cannot have a magazine in the gun, but you can have the magazines with you, which should also be fully exposed. Expect to be hassled or even arrested if you do open carry there, since no one actually does it, basically it has become a lost Right to some degree.

    Based on responses of law-abiding citizens (until Nov 20) I can just envision the response of known & would-be criminals who have felony records, possess weapons, & 10+ mags. Are they afraid of being charged with a misdemeanor for their 10+ round magazines? Of course not! Do the politicians seriously believe these ridiculous restrictions will have any impact on felony assault, armed robbery and murder rates? Answer is probably not, but remember their real goal is to abolish the 2nd amendment, or reduce it to uselessness by preventing citizens from possessing guns. A more likely outcome is for such laws to create an instant black market for smuggled 10+ RM, that way only the gangs and law enforcement will be able to effectively defend themselves. Sounds like heaven on earth. Of course, a related problem is that some District attorneys and local judges set known armed felons free to commit multiple crimes. Recently, a gangbanger who had been convicted of 2nd degree murder in 2013 was reportedly released on bail, after attacking and shooting another person in the leg after an altercation. I’d suggest that such weak-ass judicial actions have far more to do with crime than the possession of 10+ round magazines by ordinary citizens!

    I wouldn’t turn any magazines in period. And when they try to order a house to house confiscation (which I doubt). The first few who come to do so will be injured or dead ( I have plenty of training). Then or course my demise. But it will be noted in my will that I died for the cause. I was protecting my rights as a United States citizen. But the best way is to bring a militia into play and when they attempt to. Be ready. I know, it sounds overboard for a misdemeanor, but there needs to be a sound echoed all across the nation. It’s still being battled in the courts out east. And that idiot who made the speech about automatic weapons is either unlearned or doesn’t know about the 1934 law. But the sheeple behind him drooling with their liberal signs.     I guess what I should have said , I have many mags that are over 10 ,if they pay what I paid for them. well then they can BUY all mags over 10, at market price, they would be broke. think about passing that law , the end of LA.

      Looks like the the law reads any magazine that holds 10 rounds or more. My take is 9 rounds or less are OK. Just a liberal attempt to render handguns that were originally made for high cap mags useless for law abiding citizens.

    Less than 10 rounds huh. I carry a 1911 in 45ACP with 7 rounds in the mag plus 1 in the pipe and carry 2 extra mags. The 1911 worked great in WWll as well as Vietnam and many State Police carry them as duty pistols (NH & CT) all with less than 10 round capacity. A 230 grain FMJ will knock anyone off their feet (even someone high on PCP) and a modern 45ACP hollow point will end the threat for good, usually with a double tap to the bread-box. The sad part is many high cap pistols will be rendered useless because manufacturers only made magazines blocked for 10 rounds, not 9. Thank God I don’t live in LA but folks there are still better off than residents of NYC or NJ, both of which will not issue permits to carry a concealed handgun. Of course all of this doesn’t discount the fact that LA officials have their heads up their kulu and their ultimate goal is registration and finally confiscation. Sorry for the Redneck slogan but if guns are outlawed, only outlaws will have guns.

    There is safety in numbers. If we stick together to defend our 2nd Amendment rights we will prevail. Compare to Prohibition; it simply couldn’t be done. It’s too dangerous to come after staunch 2-A supporters, the hope is that the sheep will comply, and of course some will.

    One more point; the police are often lumped into the “anti” group. Many individual officers stand FIRMLY with you. I am one of them. I was an American long before I became the police. Draw your line in the sand and defend it.

I live in PA. and we have a problem here with people bitching about this that and the other things, BUT at election time only about 25% of the registered voters go to the poles, election after election. I ask you seriously, of all the people you know in your circle of friends and neighbors actually vote?
    If you truly want to do something about the ELECTED officials who infringe on you rights, get registered and get of your butts and vote them out of office……. I lived in California for 8 months while in the military, but that was in 1978, I don’t think I would recognize it now. Good luck, let your votes be counted.

Assuming this law does not result in its authors being thrown out of office, it means that a majority of the voters approve. That’s democracy.

    Arming ourselves to the teeth with the idea of fending off the U.S. government is not provided for in the Constitution. In fact we defeated an insurrection that did just that.

    I was born and raised in CA. As I got older I just kept moving further and further away from those populated areas, now I live in one of four counties, that do not have any incorporated cities.This even makes open carry legal. I prefer CCW however and do so. I see the pictures that people are holding up with their loved ones who were shot apparently with the tenth round of a ten round magazine bullet. Those people who choose to live in those population centers with the gangs, and the politicians who support them will continue be shot the same way as before, maybe with the 22nd round or the first round. Thugs that commit those crimes as always are law breakers anyway so what do the gun laws have to do with them?

        Well stated, and one of the more sustantive posts here. I lived in CA for 2.5 years while in the Corps. Being MT born and raised, I was not impressed. However, I met many right-minded, hard working, reasonable people there. Many who can’t simply pick up and leave, as so easily offered by some here as an answer. We need people there who will not give in and more of them. A problem is the large number of lazy, unemployed, social leeches in CA who rely on left wing handouts and so-called ‘social programs’. The left has long seen that segment of society as a tool, and one they really don’t care about. It’s all about votes and power. Then there is the high rate of crime and numbers of criminals. Add to that the liberal democrat tendency to view criminals as a protected class who are difficult for them to control, so instead of controlling them they use them, or their acts, to further their goal of complete emasculation of the more ‘controllable’ masses. John Q Public is an easier target for their social engeneering efforts.
        And make no mistake, they are counting on civil unrest, as has been suggested here, which they will then use to justify yet stricter controls. It’s their way. They put their opponent, conservatives, on the defensive and keep them there so they are too busy to see what the left is really up to. The true ‘Neverending Story’.

I tried to move out of this state but the boss put an end to that with the 5 grandkids being born here. I did get out of LA county into a gun friendly county and actually got my CC this year.     Well first I believe it would be considered unconstitutional andthus wouldn’t stand up to a supreme court ruling , however I could be wrong. Thus what I would do if I lived in a state that broke from the constitution, is move if I could. However, that is expensive and easier said than done. So,.. next best thing would be to use magazines of legal size while either just keeping the regular sized magazines at a friends house outside of LA or, just keep them someplace that they wouldn’t be found or have a reason for being found… but, I WOULD NOT SURRENDER THEM PERIOD ! I would keep them just in case there is a breakdown in the rule of law and would then need to retrieve them,…that’s just me though, I wont tell anyone else what to do or not do,..that’s up to them.

    I grew up in California, in a suburb of L.A.
    By the 1980s, I got the hell out of there because I could see it becoming an Extremist Democratic state. There’s nothing wrong with being a Democrat. Just like there’s nothing wrong with being a Muslim. But if you add the word “Extremist” to either of them, the outcome is dangerous.
    Vote! Get rid of the power hungry Pelosis, Fienstiens, and guv Browns (who was elected a 2nd time!) and remove them from office. If that doesn’t work, move like I did!
    Many states (like Montana) are still controlled by Dems, but they believe in our God given constitutional right to keep and bear arms. And, as long as you don’t have a criminal record, Must issue you a concealed weapon permit when you apply. Jobs don’t pay as much, but housing is crazy cheaper and cost of living is exponentially cheaper.
    It’s been quite a while since I lived in the Republik of Kalifornia, but I sure don’t miss it!

We have, at all levels of government, a representative form of government, meaning we elect people to represent us as to such matters, and other than the vote on candidates, we do not have an individual vote as to measures before a legislative body, except to the extent that we can vote out those who defy the will of the majority. Los Angeles is a democratic stronghold, and every single member of the LA City Council is a democrat. The City Council enacted this ordinance (which by the way only applies within city limits and not elsewhere) unanimously. The People have spoken.
      The only remedy is in the courts. A denial of a preliminary injunction is fairly usual where the constitutionality of a law is challenged, as here, even though the lead plaintiffs are a number of County Sheriffs who point out that they and their deputies, while authorized to carry “large capacity” magazines while on duty, if they go off duty while in city limits, they become criminals.

The 14th Amendment made clear that these laws apply to all states and all lands in all states. They cannot be abridged without committing treason and rebellion. No local authority can suspend your civil rights and that’s what firearms ownership is. They cannot define what kind of firearm nor any other thing. Accepting this accepting the breaking of the social compact that binds the Union together. This is an unlawful act by any reasonable account. They cannot make retroactive laws and by these means steal property and or thereby force people to flee their property without just compensation. This is what the Nazi’s did to the Jews.       Well, yes and no. The ten round limit went into effect January 1, 2001, but magazines owned prior to that date were grandfathered in and are still legal to possess, but cannot be sold in state. This applies to rifle and pistol magazines. And of course the police are exempted from the law, since their duty weapons are full capacity Glocks (for the most part).

      However, the LA ordinance (and the SF ordinance on which it was modeled) have no exception for LEOs. In the pending lawsuit, the Sheriffs (of counties other than LA) point of that an officer or deputy can legally possess a 10+ round magazine for a duty issued weapon, but cannot possess 10+ mags for nonduty weapons, and cannot possess such mags while off duty. So if a Sheriff comes in from out of town on duty, he is legal, but if he stays the night and is off duty, he becomes a criminal. Cute, huh? Moreover, state law allows LEOS to buy “off roster” handguns, including pistols with 10+ round magazines. Now any officer living in LA or SF who has such guns will either have to find 10 round mags, break the law, sell the gun outside the county to another LEO, or sell it out of state.
      This is actually the culmination of a program by the LA County DA to declare 10+ mags (typically AR or AK mags) “nuisances” and confiscating them–all perfectly legal of course.

    The people are the lawful government and the government only exists upon the will of the people. The contract between the people and their government stands upon the Bill of Rights. This ruling completely abridges that compact between the people and the right to rule by officialdom.

    There can be no legal justification for this without public consent, and which would have to involve a reformation of the government through a public review at the national level of the proposed laws which would supposedly function as the social compact between the rulers and the ruled. Which means, the compact between the people and the laws approved by the people are the only laws which should be honored. Self proclaimed laws are edicts, which is nothing more than Royal Orders. The courts do not make laws, we the people make the laws, but now it seems officialdom has decided the people of California and indeed the rest of the United States are superfluous to the rule of law. Evidently some people have gotten an inflated view of their own importance to the lives of the average individual.

This ban on so-called high capacity magazines is unlawful. and in contrast to what this idiotic liberal lawyer asserts, is NOT a common sense example of anything in the universe. We, the people have an unalienable right to keep and bear arms that is also not to be infringed upon. If the state is going to demand that people turn in their magazines without compensation, the the state is guilty of theft. Taking the property of people without consent or compensation is a violation of the people’s Fourth Amendment rights, and since it is being done as a claimed function of government, then it is a violation of the people’s rights under color of authority. I suggest California gun owners investigate a class action suit against the state and having an attorney specializing in Constitutional Law file what is known as a 1983 writ. Under the Constitution, the legislature had no business passing this onerous bill, the Governor had no business signing it, and a stupid, bleeding heart liberal needed to keep his nose out of it. Americans are getting sick and tired about our government working at cross purposes to the rights and wishes of we, the people. Stand up and put the government in it’s place. Remind them as forcefully as needed that they work for us, not the other way around.

Do not turn in your Mags. Every major Holiday our government projects how many Americans will die on our roads, religiously, have they made a law that has Ban the Six pack to Twin pack? Would you in LA turn in your two extra cans?

      It is a misdemeanor, I believe that the federal law restricting guns to 10 rounds was revoked. This only means that honest citizens in LA will get a misdemeanor for owning these. While crooks will get a misdemeanor just added to their felony rap. These law makers are idiots. if they make owners turn these in they need to replace the owners magazines with Mags that are less than a maximum of ten rounds. I say keep them. Use them in defense. Take the misdemeanor. It will cost the LA court system a ton to enforce this law.

      This lack of critical thinking will continue to prevail only until the citizens vote out of office those who are responsible for the misguided behavior.
      I wonder when the media will spectacularly give prominent exposure to those who legally conceal carry and stop or prevent crime. Probably never, given that most crime exists where lawfully carrying citizens are prohibited from doing so.
      I wonder when the media will begin to promote the enforcement of law and prosecution against those who commit these crimes. Probably never, given that most are bleeding hearts and want to weep over their sorry lives.
