Lawmakers Call on Biden to Address 'Ghost Guns' via Executive Fiat

Citing the threat of “white supremacy,” three U.S. senators are urging president Joe Biden to use executive action to close what they call the “ghost gun loophole.”

Sens. Bob Menendez (D-N.J.), Dianne Feinstein (D-Calif.), Ed Markey (D-Mass.) are the trio behind the push.  They made their plea in a letter (see below) that was sent to the White House on Tuesday. 

“We write to ask that you take executive action to keep unserialized and untraceable firearms known as ‘ghost guns’ off our streets,” they wrote. 

“Specifically, we request that you immediately direct the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to regulate these firearms under the Gun Control Act and ensure that they are subject to a background check,” they continued.  “Additionally, the ATF should collect data on when ghost guns are used in crimes and publicly release that information.”

A “ghost gun” is anti-gun nomenclature for perfectly legal, build-it-yourself gun kits and parts, including (unfinished) lower receivers.  

The senators contend that the Biden administration needs to act now because the popularity of “ghost guns” is on the rise “among white supremacists.”  

“In January 2020, authorities arrested three members of a white supremacist group who planned to travel to attend a gun-rights rally in Virginia and attempt to start a civil war,” they explained.  “One member of the group made an AR-15 using parts and a jig widely available online.”

Per the letter, that is the only example the senators cite to substantiate the claim that “ghost guns” are becoming the preferred firearm of white radicals and racists.  That one rifle recovered in Jan. of 2020.

Mark Oliva, the Director of Public Affairs for the National Shooting Sports Foundation, the firearms industry trade association, blasted the three politicians in an email to GunsAmerica.  

“These senators have a greater concern with law-abiding Americans exercising their Second Amendment rights than they do stopping crime,” said Oliva. 

“Home-built firearms, while gaining in popularity, are a labor-intensive and detailed process practiced by a minority of firearm enthusiasts. Any one producing firearms for sale or distribution must be regulated by the ATF,” he continued.  

“Additionally, there are already laws addressing unlawful possession of any firearm by a prohibited individual, regardless of how it was produced. If these senators are concerned about enforcement of ATF regulations and federal law, they should propose an increase to the bureau’s resources to fight crime instead of begging the president to unlawfully issue executive actions that put barriers in the way of lawful firearm owners,” Oliva concluded.  

In conjunction with the call to have Biden flex his authoritarian muscles, Menendez, Feinstein, and Markey also hope to move forward with legislation addressing “ghost guns.”  

Stopping the Traffic in Overseas Proliferation of Ghost Guns Act, the Untraceable Firearms Act, the 3D Printed Gun Safety Act are all bills they hope to reintroduce and enact in the coming months.

    Ghost guns can be used to create ghost communist politicians. Which is why we need more makers with the skills to make in home workshops. Freedom is not free. Rights to arms existed long before the constitution. One look at Washington DC and you see that Bidens communist lawmakers fear the people. Im very happy they fear gun owners. And the more Americans with so called ghost arms the better it will be. The more communists that fear the people the better. The more dead communists even better.

    I love how some “feel” the second amendment should be handeled by government when we the people are suposed to be the government with representitives of ours in political office. 2A is the insurance policy for the rest of our rights. Goid luck getting them back after the death of a thousand cuts ruins it for everyone. Not one gun law ever in our history has made any positive impact on crime. Pay attention dopey.

    i would like to see a petition signer list compared to a gun owner list to see just how many of those ANTI GUN OWNERSHIP people think they are the only citizens that should be allowed to own a gun.

    i remember many years ago there was one of those big Washington District of Criminals politicians that shot a kid for trespassing and being in his swimming pool. thing was this politician had a son that was in the FBI and the pistol the politician used to shoot that kid had been confiscated from a criminal by the FBI years before the politician shot the kid.
    and here is the kicker, his son remained an FBI AGENT and the politician remained in office and neither one was ever charged with a crime!! there were soooo many FELONIES being committed in that case and no charges even filed !

    the government of THE UNITED STATES OF AMERICA, INC. commits more drug smuggling, more drug dealing, more thefts, more murders, in just 5 years than all the citizens of the United States of America has committed in the history of the world!!

    The problem comes from the democrats who straight out lie or with hold the truth, I am an FFL and every gun buyer goes through an FBI background check, and yes even gun shows, I’ m not saying there is some sellers that don’t do background checks, BUT, they are not legal or reputable sellers, the law does allow private transfers between individuals, but unless you are a criminal, you will not knowingly do a private transfers to a criminal, biggest percentage of private transfers are family and friends. A good example of the lying anti-gun crowd is the Giffords statement that 22% are done without a background check, do you really think criminals and mentally disturbed are going to follow ANY laws at all? Even a private transfer between family and friends. I don’t know the number, but either all or a very large portion of states require that a private transfer has some restrictions, ie “CANNOT knowingly sell or give a gun to a person that is prohibited by law to own a gun”! MOST criminals obtain guns illegally ( no such thing as an illegal gun, only people illegal owners of guns) straw purchases are illegal and stiff penalties ( that Liberal judges don’t follow)
    An illegal firearm purchase (straw purchase) is a federal crime. An illegal firearm purchase can bring a felony conviction sentence of ten years in jail and a fine of up to $250,000. Buying a gun for someone who can’t can cost you your good name and land you in big trouble.
    A case in Illinois was a woman buying for Chicago street gangs, she received 90 days probation!!!! WTF?

    It used to be, not so very long ago, that one could, with a background check, obtain from the California DOJ a unique serial number to be applied to (actually engraved on the receiver of) a home built firearm. But no more. I was surprised to learn recently that it is now illegal for anyone other than a licensed manufacturer to produce a home made firearm using an unserialized receiver. So California has banned ghost guns.

    The thing is I hear the statistics of the number of “ghost guns” seized (often from gang members or felons), but I have never seen any statistics at all of the number of “ghost guns” actually used to commit a crime (other than illegal possession). Not one of the mass shootings in this country to date have involved a “ghost gun,” and in fact, in most cases those shooters (columbine aside) legally acquired their firearms. Furthermore, there have been no statistics released, that I know of, of the number of firearms successfully traced from the manufacturer to the actual criminal in cases where tracing was needed to identify the owner/possessor when the gun was used to commit a crime.

      The last time I checked, fiat EOs only apply to federal employees, so we can ignore those, since they are not laws that apply to us.
      As for the ghosts, where is the ghost president?
      No one has seen much of that ghost since he stole the presidency.
      They must be keeping him well hidden, so that no one sees that ghost, and expose himself.
      Also, what are they so worried about with the capitol still guarded and fenced in?
      That is another obvious elephant in the room…

    I have seen several of your comments over the past month or so and would like to respectfully ask you a question and would appreciate it if you would answer it honestly. Are you for gun control and would you like to see the 2nd amendment gone all together? I’m curious because most of your comments seem to be against our god given right to keep & bear arms and to defend ones self and loved ones. If you wouldn’t mind answering I would like to open up a dialogue with you.

      Chris –

      I am in favor of gun control in that I think more regulations are needed for public safety but I do not want to see the second amendment overturned entirely. Certainly the second amendment calls for regulation and guarantees the right of the people collectively without explicitly guaranteeing an individual right. Assault weapons bans and restrictions on standard capacity magazines are within the responsible execution of the second amendment and the continued right of the people, collectively, is not infringed as long as the people can continue to own firearms.

      Looking forward to a dialogue.

    I agree with the author that executive fiat is not the right way to address the ghost guns problem. Sometimes it feels like our system moves too slowly and it can be frustrating but it is best to work within that system to effect change. Unilateral moves and executive overreach can be easily reversed in the courts, which leaves us worse off than before. This is best handled through Congress.

      It quite obvious that voting in the current system is not going to result in a return to constitutional governance at the national level. The bigots and social destructionists of the Democrat Party are without a doubt today’s version of the German NDSP. The ‘Congress’ is a theatrical farce having allowed a fraudulent national election to stand. More traditional people are beginning to understand that the phony Left that controls multi-national corporate America is a physical and ideological enemy.
