Universal Background Checks Pass in Oregon

Oregon is poised to become the 18th state to criminalize private transfers between private buyers and sellers, including those transfers made via the Internet and at gun shows.

On Monday, the state House of Representatives narrowly approved SB 941, the Oregon Firearms Safety Act, by a vote of 32-28. Now SB 941 will head to the desk of Gov. Kate Brown, who has already signaled that she intends to sign the universal background check bill into law.

The passage of SB 941 was a huge victory for pro-gun control lawmakers as well as the many pro-gun control organizations that supported the measure.

“We know that background checks work,” said Rep. Jennifer Williamson (D-Portland), one of the bill’s chief supporters. “We know that in states already requiring background checks on private gun sales there are fewer women killed by intimate partners, fewer law enforcement officers shot protecting our communities, and lower rates of gun trafficking.”

Likewise, Rep. Dan Rayfield (D-Corvallis) touted the bill as a critical policy measure to keep guns out of the hands of prohibited persons.

“Support for the Second Amendment goes hand in hand with keeping guns out of the hands of dangerous people. That’s why federal and state law prohibits felons, domestic abusers, seriously mentally ill people, and certain other dangerous people from buying or possessing guns,” said Rayfield (D-Corvallis). “Background checks are the most systematic way to keep guns out of the hands of dangerous people.”

Meanwhile, former New York City mayor Michael Bloomberg’s organization Everytown for Gun Safety viewed the approval of SB 941 as yet another win in a long string of victories that provide further evidence that Everytown is beating the National Rifle Association in the battle over the Second Amendment.

“We said we would go toe-to-toe with the gun lobby in statehouses across the country – and today’s victory in Oregon, as well as the significant defeats of guns-in-schools and permitless carry bills in a number of states are proof positive of how we’re doing what we said we would do — and we’re winning,” said John Feinblatt, President of Everytown for Gun Safety.

“Legislators will no longer be able to put the interests of the gun lobby ahead of the overwhelming majorities of Americans who demand they do more to prevent gun violence,” Feinblatt continued. “Our more than 2.5 million supporters are showing up at statehouses, making calls and sending emails to let legislators know that we expect them to oppose extremist gun lobby proposals to weaken gun laws and pass common-sense public safety measures that will save lives from gun violence.”

It goes without saying that the NRA couldn’t have been pleased with the passage of another UBC bill. Sadly, it would appear that the background check movement is a bit like manifest destiny. It’s only a matter of time before nearly all 50 states adopt a UBC bill or the federal government passes one into law.

I don’t mean to sound like a defeatist, but in many ways the writing is on the wall. Public polls continually show overwhelming support for background checks. Bloomberg’s got billions to back the UBC moment. It is the lowest hanging fruit in terms of gun control, which is why politicians support it (gives them a sense of accomplishment, even though there’s little empirical evidence to suggest that background checks save lives). And at the federal level, Hillary Clinton is poised to take control of the White House in 2016.

The other way to look at it is the NRA has limited resources, which means it’s faced with a very simple choice: dump precious dollars into fighting what appears to be a losing battle (background checks) or save money to fight more winnable battles like expanded bans on widely popular black rifles and magazines, e.g. the New York SAFE Act.

Sure, to keep up appearances, the NRA is still going to put money into defeating background checks. But it’s going to be a lot less than what it spends on defeating other policy measures because it seems to recognize that resistance on this front is almost futile.

Ultimately, time will tell whether I’m right or wrong. Hopefully, I’m dead wrong.

    I’ve been warning everybody for years now about their insidious agenda to undermine and marginalize the 2/A through the nullification of your privacy rights and agenda based proprietary laws sponsored and funded by leftist traitors. But I’m still ignored, even by those who call themselves pro 2/A Patriots!

    I told everybody i could about the exact sequence of events to precipitate the final,, all out confiscation push. I even amazed myself–which doesn’t happen easily anymore–on exactly how accurate my predictions were. But I, and others, were ignored for the most part. We were just conspiracy whacks crying ‘wolf’.

    But the recent ‘administrative’ change in the ATF required firearms purchase form 4473 questions–which i predicted right here on this site a long time ago– happened exactly as I called it, and now it will be much easier to simply enact by executive fiat, the instant banning and confiscation of firearms from combat Vets with PTSD, or anybody with a legal prescription drug habit, or any other ‘mind altering drugs’, legal or otherwise, and anyone of the statistical ‘one out of every’ 3 or 4 Americans with Psychological issues or emotional disorders whom the ‘authorities’, because they’ll ALL easily fit into the sinister paradigm for ‘illegal possession’ of firearms when ‘THEY’ want! To wit: question ‘f’, page one, Firearms Transaction Record Part 1: (“includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself, or to others, or are incompetent to manage your own affairs”) (this is part of the heavy PTSD diagnosis)

    If you listen to the ‘wording’ carefully, you’ll notice the wide stretch and reach of ‘discretion’ in subjectivity with the ‘determinations’. Right now, it’s ‘legal’ for a doctor, ANY doctor, not just a psychiatrist. and even a clinical psychologist/social worker, to call the cops on you for saying what they perceive (not verify) as ‘crazy’ talk, even though they could be wrong, and the police can come in without a warrant and seize your guns. It is already happening everywhere. This extreme Hitlarian Crime Prevention’ on psychedelic mushrooms!

    But here’s the BIG Prophesy for all you gun slinging Free American Citizens. All this treasonous manipulation of our rights is being culminated into one massive ‘coup de gras’ on our firearms ownership. All coming to the church of tyranny to celebrate the funeral of free gun ownership by the end of this year.

    It is called your ‘National I.D. card’ or “papers and guns location, please…”. aka, The “REAL I.D. ACT’ of 2005.

    Oh, ya’all forgot about that one, huh? HAHAHAHA! It didn’t look like many of us even gave a shit when they slipped it into law back then. It was so slick that it proves what i’m about to say next. And it was oh, so, veeeery slowly implemented through the states with similar State ‘bribery’ like the Marxist billionaires are pulling with private sales and background checks.

    You really never thought by any misfire of your minds that the leftist totalitarians were EVER going to rest their pinko bones just because a few courts here and there ‘reaffirmed’ our 2/A rights to own guns, did you? Especially since we all don’t really deserve anymore to own them according to two basic factors. One is that the Constitutional Traitors don’t want us to have guns, no matter what the 2/A sasys, and Two is that we are so stupid and incompetent to have guns because we let them get away with it. Even Though What They Are Doing is FUCKING CONSTITUTIONALLY ILLEGAL!

    The Last time I spoke to Wayne i said why are you wasting all your donations and peoples’ time on throwing air soft BB’s, instead of a REAL BOMB!     We and the NRA should be outraged at this. But the ACLU is literally begging on their knees for donation to fight the re-instatement of the Patriot Act sunset NEXT WEEK but nobody seems to care? It’s not even news on FOX anymore–but that’s another turncoat story. The only media even talking about our liberties draining down the sewer, is Free Speech TV,(channel 348). And a few finger in the wind politicians who will flip like a cheap cheeseburger when a certain billionaire pulls his puppet strings.

    These usurpers of our Freedoms will never stop until they ban and confiscate every viable means of resistance to their totalitarian wet dreams. Otherwise they can’t defeat us without a real fight.

    I told Wayne that the ONLY way to stop them once and for all is to get a massive grass roots movement to REPEAL the National Firearms Act of 1968 which was never ever designed to prevent the wrong persons from possessing weapons. In a Free Country, this is an absolute impossibility. It simply goes with the territory. And in an equitable system of crime and punishment and justice, Our laws and penal system MUST account for rehabilitation and all rights restored after you pay your dues and are freed, otherwise we get what we have, which is then a disadvantaged subculture of mostly poor minorities, who are automatically made into a permanent criminal social entity. And social disorder follows and the vicious cycle feeds on itself.

    But even more importantly, the ’68 GCA was a devious far reaching program to eventually empower the Power Elite–ANY power elite– including Both political parties–to enforce absolute control over the population.

    BY SIMPLY MAKING CITIZENS IN OPPOSITION TO FASCISM CRIMINALS ANY TIME THE OPPORTUNITY PLEASES THEM FOR THEIR AGENDA, and taking away their ‘prohibited’ guns. But real criminals don’t care about ‘prohibitions’, Not while the jackbooted alphabet agencies charge whiskey and whores on company credit cards while they are trying to ‘prohibit’ our gun rights that we pee-ons will never afford…even though WE pay for it!

    Because once you make them criminals, you can erase their threat of physical resistance to the power regime.

    Think about it. It used to be only Felons weren’t ‘allowed’ to have guns according to the ’68 GCA? Now, as we slide faster and more furiously further down the slope of tyranny, it becomes ‘specially tailored’ laws and mandates to make POTENTIALLY Psychologically ‘unstable’ or subjectively ‘diagnosed’ as ‘dangerous’ citizens prohibited to possess firearms? They don’t even use the word ‘Felon’ anymore as in the above statement here by one of the gun fascists using the PC word Prohibited as a catch all term which will soon include just about everyone they want.

    Not only was the ’68 Gun Control a black-ops gun registration and ownership control move, but it was the beginning of the end of private ownership of most, if not all, guns by Citizens in the future.

    And the future is finally here, NOW.

    If we get Congress and the Senate to REPEAL the 1968 Gun Control Act,–while we still can, before the Left gets it back next year– (oh, you really didn’t think ‘They’ would let Republicans keep the Congress and the Senate, now, did you?) then we won’t have to worry about losing our right to private transactions, or the goverment even knowing what we have, let alone knocking at our doors at 4am. There won’t BE any illegal intrusive back ground checks that criminals don’t worry about anyway!

    When i come back this weekend i’ll tell everybody exactly how they’ll perform the final confiscations when Hillary gets the POTUS throne, which will be about the time when all the pieces to the tyranny confiscation puzzle picture fall into place.

    Meanwhile,ruminate and ponder the manifestations of what the ‘REAL I.D. Act’ means.

    And try to solemnly comprehend what one of our old patriots, ‘FRED of Shotgun News’ recently said in one of his essays.

    Because without it, we aren’t really alive.

    I’m waiting to see how LONG this law will stand when a cop, going through a bitter, protracted divorce, gets SLAMMED AND ARRESTED then thrown in jail–for words spoken in haste during a heated argument. Suddenly, foolish words, e.g( “take the kids and I’ll kill you”, ” I’ll see you in the ground before you get the kids or the car, or the house”, ” before you financially rape me or ruin my reputation and my life”, etc.,etc.

    Here in Virginia when you purchase a firearm from a dealer no serial Number is recorded, Only that a long gun or hand gun was sold, sooooooo trading would be a good option, If you had a gun someone wanted and he or she had something you desired ( flush your dirty minds 🙂 ) then an equal value trade would work. say food for guns, firewood for guns. The possibilities are endless

    I am going to love seeing how they enforce this. This assumes that they know where each and every gun in Oregon is. And that they know where they are, all the time. The only way the can do that is to form a ‘gun registry’ and institute warrantless searches of all private spaces so they can make sure every gun is where it’s supposed to be. If you think the war on drugs is a waste of resources, imagine how many resources this would take to enforce. Against legal firearms owners.

    I figure there are ~100-200 legacy firearms purchased before the Gun Control Act of 1968 for every firearm purchased after. Form 4473s aren’t computerized. Even records of sales from manufacturers haven’t been computerized for more than 10 yrs. and they don’t lead to end users. Paper records will make tracking firearms purchased prior to 2000 impossible. That’s millions of firearms that are untraceable since 1969. Plus hundreds of millions the BATFE has no knowledge of, because they were purchased before 1968.

    Finding all the guns in the state is like finding a 100 grains of black sand in the middle of a white sand beach. It’s very difficult and in the process, it keeps moving around. They can look forever and not find all of them.

    What a waste of resources.

    I don’t so much mind a UBC itself, BUT it is absolutely abhorrent for ANY database to exist containing any more information than that “citizen Smith passed a UBC”…not whether or not a firearm transfer actually took place, and ABSOLUTELY NO description of any said firearm that was or wasn’t transferred.. The UBC may be inevitable…but it MUST be kept to ONLY that!

The best comment I read was something about making your own. Support the underground economy who can create firearms with no serial numbers.     The approximately eighty million gun owners in America need to all join the NRA – even if they’re too cheap or don’t always agree with the organization – and become a vocal, stand-together group. The 2.5 million or so delusional people who comprise Everytown USA or whatever Nanny Bloomberg wants to call his group wouldn’t stand a chance! Gun owners are too quiet and either complacent or tend to be defeatist like Mr. Blannelberry. Also, the Democrats are not on our side, look at their voting records! vote for and support Republicans or Independents who are truly conservative and in our corner such as Ted Cruz, for example. We have the power and the patriotism to stand up for our constitutional rights and turn our country around if we wake up and start speaking up loudly and persistently.

    Why all the rhetoric about leftist politicians trying to grab guns? Wake up! All people in power want to keep that power for themselves and their cronies. The right wing Republicans go along with the pro 2nd amendment because it is against what the left wants, but don’t believe that they are your friends.
    Nixon believed in gun control, especially against those that did not follow him. This is a huge problem and we have to be eternally aware what is happening and have to limit their power as much as we can.

    Example, Line Item Veto. Now, it might sound ok to some of you when you agree with the president. When we get a person in there that is drunk with power and wants to take it away from those of us that hold on to our religion and guns, we have a problem. Proper balance of powers is why our country has survived as long as it has, even after the war between the states(that limited states to what the feds wanted).

    There are many reps in sheep’s clothing. They are only waiting to deny our rights, so they can make their bosses(huge corporations) even richer. We all have to educate ourselves and VOTE. All freedoms are important. Giving up one because you believe it is only helping someone else is playing into their hands. The ACLU should be protecting all rights, not only their politically motivated agenda.

      Indeed. I’m a liberal when it comes to human rights, and equal representation, but I’m a fierce supporter of the Second Amendment. The first step in turning a sovereign country in to a threat-less mass of citizens unable to protect themselves from tyranny is the route to total control of all of the citizenry of the US. Right now, voting is the most effective measure to contain and confirm our Second Amendment rights. This doesn’t mean to vote for the loudest conservative who vows to protect our rights. Most in congress arrive hoping to get rich, which most of them do by the time they “retire”. When you do enough favors for the right people, you become rich for life. There was a movement to restrict congress to a term limitation, by amending the Constitution. I’m not sure where it is as far as progress goes, but if you encounter it, please support it. Our Congress has become completely controlled by the wealthy corporate owners and investors. Get wise folks, start demanding change! Preserve our rights by VOTING!!

      Very well put. Don’t let them divide us based upon a Left/Right paradigm that they themselves don’t believe in. Money and power do not take sides–except when it is convenient, i.e., they have no fixed principles and therefore conscience has no meaning for them. And, to take it a step further, since conscience defines us as human, this means that these politicos are not human. They have turned to the dark side; they cannot and will not help you.     Its a sad thing there are people like Bloomberg that have the money and influence to create laws that affect law abiding citizens. UBC is his first step in a plan to eventually ban all weapons he finds offensive, not because of the danger they pose but just so he can crow like a rooster and say, “Look what I’ve done”. Its sad to know that he can afford any type of bodyguard protection and the rest of Americans have to depend on an overworked, out gunned, and more recently demonized police force. Name another job where an officer leaves home and has no idea if he will ever return to his family when his shift is over. I learned long ago it is not a good idea to depend on our police force to take care of the dangers facing ever American everyday. The police would gladly step in to protect the public but that option is not always available. People have to take some responsibility and Bloomberg is determined to take that option away. He doesn’t have a plan to take the place of a person’s right to self protection, he just wants to blindly take the option off the table by gun control. He is the most despicable individual for his actions and if he thinks history will remember him as man of honor, he is sorely mistaken. He will be remembered as a self serving bag of cash that cares about no one except himself.

    I don’t see how a UBC law would be enforceable. The number of federal agents or local LE that it would take just to monitor parking lots at gun shows would overwhelm the system. It’s also my understanding that there is no “federal” register of firearms, only dealer records which the Feds have access to if they need to trace a firearm used in a crime.

      You can’t buy a firearm at a gun show in CA and walk out with it. It has to be transferred to a FFL for the mandatory waiting period and then you have to fill out a 4473 and undergo a background check before you get it.

      I used to live in CA. I’ve seen a lot of accessories walk out the front door of a gun show. Never seen any firearms walk out the front door. Of course, maybe there’s some I’m not seeing.

        It seems to me that guys walked out the front door of gun shows with newly purchased firearms in CA all the time. Vendors that didn’t have booths, bring firearms and sell them bypassing the background checks. They are, truly, ‘private’ sales. When I lived there and went to gun shows, there was plenty of opportunities to buy firearms and leave with them that day. No background checks and no 4473s.

        Law enforcement in CA didn’t have the LE resources to police the gun shows. Nor do they have the interest to pursue widespread enforcement. There is no way to know how many firearms went out the front door in CA, since there are no records. There are, also, no records of whether these firearms were subsequently used in crimes.

        The whole thing won’t work out without universal gun registration. NO ONE has the resources to implement that. No one is voluntarily going to let them through the door for a little unannounced 4th amendment violations. And it won’t work without a complete abrogation of the 4th amendment. Plus the government has no way of knowing how many, or even whether, you have legacy firearms. And I don’t see many people lining up to tell the ATF what they have.

    Illegal gun laws will not be recognized by myself. I live in Arizona and I do try to keep within the law. But I cannot abide with the rampant tyranny regarding my Constitutional right to keep and bear arms which permeates our society even here. I am willing to go to the mat over these civil rights which have been under attack from the highest levels of governments, local, state, and federal. The 2nd Amendment is the very bedrock of this nations values. The sad part is that police are likely to bear the brunt of my wrath. It is them who are charged with enforcing illegal legislation such as this and so much more. I don’t want trouble with police, but I will also not hesitate to fight for my liberty which is put at risk when I run afoul of illegal legislation. I do not have the financial resources, energy, or patience for drawn out legal battles, or the willingness to submit to such tyranny for a solitary minute. My battles will have to take place in real time, on the spot. The will end badly for me, as well as enemies of liberty. I accept this and my pledge is to take more of them before I am taken. As far as I’m concerned, we can all go and be judged together. By the highest of judges. If somebody has a better way, please share it with me. This is not what I want, but I do not see any other way.

      No, you are wrong. The First Amendment is the bedrock–if a man is defined by his conscience which it is the Second Amendment’s duty to protect as an instrument, a means to a higher end. It is a mere instrument important through the higher end it serves. That higher end is freedom of conscience, i.e., the First Amendment. Indeed, if it comes to it we can defend our integrity using a big stick rather than give up a free conscience. Of course, we would rather have a weapon like those that are going to oppress us, and already do oppress us, but we can still choose to fight with what we have rather than suffer further insult. So, let’s not confuse the First and the Second.
      And, since we are on the subject, note here that it is pretty clear that in amerika conscience has already become criminalized. Just test it in a big public way and see what happens, eh?
      Again, while I’m on the subject, how many good gun totin’ Red Necks Constitutionalists in Arizona (my state also) honored and supported Bradley Manning’s and Edward Snowden’s desire to listen to their conscience. Not enough, that’s for sure! My view is that this is a sign, an omen, that when push comes to shove those who need the support of their fellow Americans will not get it because for many many good Constitutionalists (Lord save us!) the Second Amendment is not about protecting your neighbor’s right to speak his mind, but all about blindly supporting a clearly imperialistic military not one action of which is supported in the U. S. Constitution. Jesus! The Polish could find “solidarity” over wages. We can’t find solidarity over anything–so deeply divided have we allowed ourselves to become, led on by a corporate media that is both Left and Right (i.e., indifferent to true American values) and which has as its primary goal a nation divided in its ignorance of any unifying principles whatsoever!
      My advice to most of my Redneck friends (as well as good sensitive Leftists) is to read the Preface to the Constitution and ask yourself what it means when Jefferson writes, “all men are created equal.” Think about this and think about what it will be like in the future if we let secondary issues divide us and remain ignorant or indifferent to those principles that are absolutely essential and which are the only thing around which we might find the necessary solidarity. ‘Nuff said.

        Well, maybe not enough has been said on this topic. How many good freedom loving Constitutionalists were willing to support the protesters at the Occupy Wall Street gathering? Not enough that’s for sure. Apparently their free speech is a little freer than that of those who live in New York and dress funny, or who don’t go out with girls, etc. Sorry, but I just can’t get behind this trivial, and therefore dangerous, form of (limited) free speech. Hell, the Rednecks came to Waco to help the Feds shoot the Branch Dividians! Did any of you read about that? Why? Because they believed what the official propaganda “news” sources told them–that they were freaks, different, child molesters, etc! My guess is that many of these folks have never read the Constitution. Or, if they have it was with the eye of prejudices so deep that they were blind to any meaning other than the one they came with. And yet, “all men are created equal, eh? Jesus! JWC

    I can’t believe what this Nation of Patriots is letting the left wing democrats propagate this lie and assault on our Constitutional Rights! Wake up America, our life, liberty and what our founding Fathers created is being chipped away like some communist country. We have lost what governnment was supposed to be. Instead of representing the people, politicians have grossly turned it around where its all about supporting their shallow views and doing away with our Constitutional Rights. How is it that a politician can serve a single term and reap a retirement that the citizens pay for out of their hard earned wages. The less than two percent who swear an oath to serve this Nation unconditionally retire after 20 plus years and only receive half of their base pay? Where is the Justice in this scenario? This Nation needs to get back to it’s grass roots and serve the people and not it’s politicians! I pray that we as a Nation wake up from this stupor!

    The BG check is not the main problem. The problem is the Government knows who owns what forever, and when the carpetbagger billionaires want to ban guns down the road, they know where they are and who has them. This is the first step toward total confiscation. It ill likely take several generations, but Utopian gun grabbers are fanatical and as patient as they are wrong.

      You are right, though it may not take several generations for big government to accomplish this. I think they are just hedging their bets in case they are not able to pull it off sooner. Look at what happened in New Orleans–they just came and took them. I did not hear of any resistance–though that may just be the media screen. Look what happened in that Boston suburb–they just came in and took people out of their homes, hands up! No one seems to have resisted. Doesn’t anyone any longer know the words: “Get a warrant or get the hell out of here!” Jesus. When will we get some spine. I mean there is lots of big talk but the facts do not look good so far. I hope I am wrong. JWC
