Florida May Have Just Accidentally Banned Aftermarket AR-15 Triggers

Florida’s shiny new 105-page “public safety” act is a veritable pu-pu platter of 2018’s most popular school-shooting-prevention policies. It covers everything from armed teachers and mental health to age restrictions and “school crime watch programs.”

But one of the bill’s smallest sections could turn out to be the most contentious. In response to last year’s mass murder in Las Vegas, the Marjory Stoneman Douglas High School Public Safety Act bans bump-fire stocks along with any device “which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device.”

Here’s the entire section:

790.222 Bump-fire stocks prohibited.—A person may not import into this state or transfer, distribute, sell, keep for sale, offer for sale, possess, or give to another person a bump fire stock. A person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s. 741 775.083, or s. 775.084. As used in this section, the term “bump fire stock” means a conversion kit, a tool, an accessory, or a device used to alter the rate of fire of a firearm to mimic automatic weapon fire or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device.

Devices that “mimic automatic weapon fire” likely include bump-fire stocks, trigger cranks, and even, according to attorney and GunsAmerica Managing Editor True Pearce, binary triggers that fire one round on the pull and one on the release.  Pearce added that the law is “overly broad, vague and unconstitutional.”

How on God’s green earth can Florida gun owners be expected to determine whether their device increases the rate of fire to that which “a person” would be unable to achieve unassisted by that device? In general, aftermarket triggers with a lighter pull and faster reset allow shooters to increase their rate of fire. Does that mean that Florida just banned these types of triggers?

Mums the word right now from the Florida legislators who just rammed the bill through Tallahassee. The only office to return our request for comment was Speaker Richard Corcoran’s. When we asked his Communications Director, Fred Piccolo, if the Speaker could clarify this issue, he said that our question “is delving into a legal opinion and that’s not something we can provide.”

“I’m not saying he doesn’t know,” Piccolo clarified after we asked why the Speaker voted for the bill. “We’ve all read the statute. Interpreting what is and isn’t covered will be the provenance of the judiciary. But he has his opinions on what is and isn’t covered. But to ask if certain triggers are now illegal is not in his Constitutional Lane [sic].”

We offered to print the Speaker’s opinions but never received a reply.

For now, it looks like Sunshine State residents will have to wait and wonder what kind of devices Florida legislators aimed to ban, even though Florida legislators don’t seem to know themselves. In the mad rush to respond to high school walkouts and anti-gun hysteria, a historically pro-gun state may have just banned trigger systems used in thousands of legally owned rifles.

Even if they didn’t, and the courts rule in favor of gun rights, their potential negligence will be tough to excuse.

    I bought a Taccon 3MR years ago after I felt the break. I have never tried it on the short reset. I just loved the way the trigger felt on “Semi”. The original ones had a bad hammer spring. If stored with the hammer cocked, it would weaken the spring to the point it would not set off a primer cap. They sent out a new main spring and has worked flawless since then.
    The problem with law makers is they don’t know their a$$ from a hole in the ground when it comes to weapons function or tactics.
    During the time I spent in the 10th and 11th Special Forces Groups, I hardly ever fired full auto. We wanted to make the shots count. A skilled shooter could do far more disgusting damage with a handgun or even with a shotgun. One of the Mossburg 590’s with high capacity mags could be devastating. Look at London…they throw bombs. No law restricting weapons function will ever stop this type of violence. When there is a will being driven by a sick mind, it will happen regardless.

    This Florida resident will not vote Scott for Senate or for any or legislator that voted for this new firearms legislation. What is most bothersome, in this law, is the behavior by a respondent undergoing a “mental health crisis,” as determined by police, may have all firearms and ammunition under the respondent’s control removed. Ultimately the burden of proof will be upon the respondent to show the court he/she is not crazy to get the property returned. The law also gives the respondent permission to retain a lawyer; wow. thanks a heap. The former Soviet Union, for the few remaining of us that heard of it, used to commit the enemies of state to mental institutions at a whim. Forget the rate of fire gadgetry available with AR 15’s, this is a much bigger concern.

    The only way to “fix” this of course is to ban semi-auto weapons which is the next stop on the gun banner wish list. As soon as Democrats get back into office this should occur very quickly.

    I’m a transferred Yankee. Been living here for over 20 years. Father bought my first rifle for me when i was 10; single shot 22. Owned firearms ever since. Please do not loop all of us Yankees into one bunch. Both my father and i served our country, him in WWII, Navy/Marine Underwater Demolition, me a knuckle dragger (crew chief). Live around Northwest Florida in a LARGE military supported area. Just don’t throw us all under the bus.

      ES, I still have a house in PCB right by the Navy base and acreage off 231 and 10. I know what you mean about being lumped together. i now live down here in Fart Lauderdale (not a misspelling) and have to put up with the same thing in a state I was born in, raised in and returned to after 20 years in the military. Grew up with guns and rifles, never thought of using them for anything illegal and never injured anything I wasn’t aiming at. Still, I have to take all the crap from the northern assholes who think we need total gun bans. They “see” murders/shooting in our low-income neighborhoods and think that is typical of all South Florida. Just do me a favor if you want my guns — come and take them from me.

Or since Jerry can use his unaided fingers to generate 400+ rounds a minute will any device that produces something less than Jerry’s trigger finger rate be legal since it doesn’t exceed the unaided finger rate of fire?

      Jerry will be the “person” used to set the standard by which this can be judged. If he can operate a specific gun as fast or faster than whatever “device,” “kit,” or “accessory” is being judged, then the item doesn’t run afoul of the law. Or at least Jerry, and others like him, will demonstrate that the law is so poorly written (because there are persons like him that can operate a semi-auto firearm at rates equal to full-auto guns) as to be unenforceable.

      I will settle for the Miculek Rule. Nothing that can fire faster than a 63 year old man (Jerry). I think that 400 rpm is with a revolver. I saw him fire an AK semi as fast as a full auto next to him. I do not recall whether he won or not but the difference was hundredths of a second.
      Regardless, it is not how many rounds a weapon can fire per minute but rather how many aimed shots can be made in one minute. When the world improvers see Clay whacking plates at one mile with the .224 Valkyrie or the Creedmores they will have a new hissy fit. As NRA member John F. Kennedy said, “the price of freedom is eternal vigilance.”

After living in Colorado for 62 years I moved to Kansas after retirement because of the liberal bastion Colorado has become taking my $500,000 retirement dollars with me that Colorado will never see.     Most have forgotten David Olofson. He was convicted for transferring an unregistered machine gun. His AR-15 was lent to another individual who operated it at a firing range and the firearm misfired causing a multiple burst. Tell me there won’t be prosecution for some of these “trivial” items mentioned. The RICO Act is used on multiple occasions to send individuals to jail, not just for the Mob. Pay attention.

When the electricity good out young people don’t have a clue what to do. Most young people don’t recognize the long term impact of gun rights.       If you look at news sites you will see that anyone who wanted to march for school safety but not to wipe out the NRA and confiscate guns was not allowed to attend or speak. There are lots of them from that very school in Parkland.

Which one of the school shooters used a device to speed up his rampage? This is truly an attack on the law abiding. I have one of the bump style stocks and I COULD LIVE WITHOUT IT, but WHY SHOULD I?     Florida is a purely Socialist state and things like this bring it to light. I moved here from NH in 03. I had been doing my alarm business for 17 years but when I inquired about doing it here, the basic rules put me out of business before I could get started. I now needed a license in every County I planned to work in, employment with a local business for 2 years before I could do my own business, and I needed to pass a test given once per year ( I think in Gainsville, can’t remember ) prior to my selling and installing low voltage alarms. I continued to sell diy alarms on line ( diyalarm.net ) but I lost my ability to support myself and my family cause I couldn’t jump through all those hoops. The weather is my reason for staying but I’ve had to accept that there is no freedom here. Now they are out to get our guns, one piece at a time. Governor Scott and all of his cronies can kiss my butt.

          Not my school system. I’m a teacher and I talk about target shooting and hunting all the time. I encourage my students to take the hunting training class and to bring me some jerky and/deer sausage. My students are not brainwashed to hate guns by any means. I don’t know if any teachers that talk about guns in an antigun kind of way. Most of us have a ccw license even.

      The weather is the reason you stay? There are several states that have warm weather. Arizona, New Mexico and Nevada are just 3 that cone immediately to mind. Texas as well. Oh and all of which have sand if that’s your thing. And all 4 of those states have decent gun laws. So, if it’s the weather keeping you there but feel trapped because of the socialistic politics ( your implications, not mine ) you can always move to one of them. My heart has always been in Florida. But I am a single issue voter. Gun laws! Period!! That’s what I base my vote on every time. Who I think will protect MY rights and everyone else’s rights and who will OBEY and honor the constitution when it comes to guns. But now that the politicians have completely caved over one school shooting and have decided to ROB honorable citizens of their rights. I am having a change of heart on moving to Florida. I live in a state that allows us to have fully automatic weapons. Just pay the tax on it. And trust me. There are only a few of states that allow citizens to own them as a private citizen. You don’t have to have a government job or a special license. Anyone who can pass the background check and is willing to pay the tax on it. Florida WAS one. I highly doubt that’s the case now. I feel extremely bad for the families involved in the mass shooting. But don’t trash my rights because one NUT JOB shoots up a school. Why go after the rifle? Because it’s “easy”, how many people are going after cars because a drunk driver killed several people. You DO NOT blame the item. You blame and go after the PERSON that used the object to commit the unforgivable horrible offense. Not the item used. But with the media always on the liberal side of everything they have been and will always brainwash the people of this nation to get their agenda passed!! And once they finally decide to just all out ignore the second amendment the government will turn into a tyrannical, controlling entity. We are the only nation that has the freedoms that we do. This nations citizens needs to stand up and defend their freedoms from the government. And the second amendment is the MAIN amendment that keeps this nation a republic. Because an armed citizen that is continually beaten by the government over and over will eventually rise up against the injustices that government is forcing upon their citizens. The government works FOR the people in a republic. Hence the saying “for the people by the people. “ the government in a republic is suppose to fear the people. But when you have socialistic representatives in office that continually try to convince and eventually do convince the citizens that “this is good for everyone “ and get more and more laws passed that take away the rights of the citizens it begins to change the nation and weaken its foundation. And eventually it falls when enough is changed to where the citizens have no rights at all. So the citizens of this nation NEEDS to realize what’s happening. Right now all these baby steps that’s being taken will add up and cost this nation it’s very Freedom’s the citizens have right now. This is why I am a SINGLE ISSUE VOTER!! Because this one issue is the MOST IMPORTANT one of all.

        Here in Florida you could have all the fully automatic weapons you want.
        As long as you’re in compliance with the federal law and have the tax stamp go ahead knock yourself out, by all the full auto guns you want .
        They banned bump stocks and binary triggers and any other rate increasing device.
        Full Auto weapons are still perfectly legal

    Tim from MAC made the point very clear along with myself and many others…The bumpstock ban wasn’t about banning bumpstocks, it was about setting a precedence to ban semi-auto firearms all together. But you know, so many people said they were alright with banning bumpstocks. Sacrifice the bumpstocks because they are novelties and pointless so that we can get the Left off of the gun control agenda. Well, here it is folks…Maybe now some of these people will realize we have to stop right now giving the Left any more room to breathe when it comes to gun control. Otherwise, this is what will continue to happen, in every state. Vague, muddy, slippery slope legislation written to control more of our rights and making people criminals over night if they don’t comply.

    “CRAZY” do they really think someone wanting to do harm with a bump stock will throw theirs in the trash? It would be easy to build a make-shift version in your garage. I guess they would rather me make a less accurate shot on an animal than to risk one or two extra rounds being fired out of a gun with upgraded trigger. The shootings will continue and the gun grabbing will too. This has nothing to do with safety. My niece and nephew were told the walk out at their school was just showing support for the loss of students in Florida. Not the real reason “gun restriction”. The liberals tell the kids what to do under false pretense, then convince them they are doing the right thing because they could be next– If all the guns aren’t taken away from the law abiding.

    As much as I agree that poor legislation is not the answer….as it applies to this article I think you are over-stating and over-reaching a bit. A lighter trigger with possible shorter reset is so far down on the understanding and consciousness level of the average politician , citizen, or news agency that may have it in for gun owners…..that this point is (in my opinion) a non-issue. It is quite a stretch to portray an “improved” semi-auto trigger action as being a meaningful contributor to increasing the rate of fire where it can be “Seen” by a non-gun person as violating the law.

      I like your view and I agree with it for the most part. Everyone stretches bad on these things and they rarely, in the end amount to much but it’s wise to consider them carefully. According to Tac Con, their miracle trigger is all you need. With a name like “Tac Con Auto Trigger 3MR System”, it’ll be hard to convince people otherwise. As claims like this exist out there, I’m uncomfortable with this legislature.

    Like I stated when I wrote my rep and the miserable excuse for a governor in opposition to this nonsense,
    As with anything done in haste and without serious thought and reflection this legislation is bad legislation. Everyone is screaming we must do something, but something done is haste is often worse than doing nothing at all. Most of the legislation will at best do nothing and possibly even make things worse.
    Even the sections dealing with hardening the schools were not well thought out or researched. Did you know the polycarbonate in bullet resistant glass degrades when exposed to UV light and must be replaced every few years in order to retain it’s effectiveness?

    But the rinos rammed it through.

However, it may just go without saying among the thousands of law already not enforced these too will fail to make a difference and fall of the radar of day to day police work.

    Two real problems, one bondi is taking guns under the baker act more aggressively than before and potentially unconstituionally as a reaction. I really dont want to get down this rabbit-hole. Bottomline, a clear process for getting yourguns and rights back after a claim is made to baker act someone needs to be clear, expeditious and should procide undue burden, cost or lack of a concrete due process to do that. Ive seen cases where an Ex-spouse wants to get back at the other, calls in a comlpaint of attempted suicide, no judge, no jury individual gets baker acted as a threat to himself or others, guns get confiscated. Individual is evaluated and released with no concerns, is not a danger. Now the indicidual has to get a lawyer, petition the court, have a hearing, provide evidence that he is not guilty, ( so much for the prusumption of innocence) and after that the courtcan garnt you back your rights. Ive also seen this exploited, especially in states like Pennsylvania. Commonly done to veterans as well from dr.s in the VA.

    The second issue is with the terminology here, a tool or an accessory meant ti mimic…i can bump dire almost any semiauto, without tools. Mimic is not a legal definition that meets the legal federal terminology differentiating semiauto and fullauto. Is a device a drop in trigger. Since its ne piece i would say yes. So, no tachon 3mr triggers? So, no wilson combat trigger? Any time you drop in a trigger kit that lightns the pull, shortens the take up and resset to shoot faster is that mimicing a fullauto? I can fire my wilsons with 3-6 rd burst that almost sound Full-auto.
    The 3MR has almost no reset, so its almost like bumping it in a way, it takes almost no movement to reset and fire. A little faster than the wilson triggers once you get the hang of it. This garbage needs clarified.

    So, my daughter, 18 just joined the service, is going to be in security forces, at 18 she will carry a loaded pistol and an m-4, guarding the nation. When she goes home to her apartment, she loses her right to now either have a shotgun or a rifle, maybe a similiar m-4 to protect herself, becuse she isnt 21. Also, she cant keep a rifle or shotgun, so in effect, she also just lost her privelege to hunt, because not 21, so no rifle or shotgun allowed.

    Scott is gonna lose this one in court and at the election box. Bondi will pay a hefty political price, shame as she is most likely bucking for a federal seat sometime in the near future. This will follow her also.

    pull/release or release/pull triggers have existed on competition shotguns for a hundred years.
    The issue is this law is so broad and open to interpretation (always dangerous) that it could, given a required level of prosecutorial zeal, sweep up anything from competition triggers up to belt loops and string.

    If we use Jerry Miculek shot times as the baseline: all devices are good to go. We also can do “reciprocating recoil fire” by hand, which is another no device baseline which woud be very hard for most triggers to exceed.

    Stunning that they are tasked to write clear, concise Laws that are supposed to eliminate any gray areas from the start. To Pass a 105 page Law and have no personal understanding or interpretation of what it means is dereliction of Office!
    Do you know they reversed the Due Process Clause like they did in the original stand your ground Law which was thrown out later? There’s also a Section on Rape Crisis Centers in there. WTF. It also SPECIFICALLY EXCLUDES All “Classroom Teachers” from being any form of Armed School Staff. That leaves admin, janitors, councilors and kitchen staff as the volunteer pool! They neutered that at the start because THEY DON’T WANT DEFENSIVE FIREARMS IN SCHOOLS EITHER! The remaining security will be no more effective then the thinnest window glass. They don’t really want solid security they just want more gun laws.

    So the way I read it, the primary intent of the law is the ban devices that mimic automatic fire. Since 2 rd burst is a form of automatic fire, it could be interpreted that binaries are now illegal. This would not include registered machinegun conversion devices, as they are already exempted under 790.221(3), and the intent was not to ban machineguns, only things that mimic automatic fire. Lastly, I dont want to be the test case, but I think it will come down to “sporting purpose”. General competition triggers will be exempted where as specialty/gimmicky triggers will fit the ban. This is such a poorly worded section, I wish we could ban, demwrit, sanction legislators that make such unconstitutional, vague and poorly written bills…arent they all lawyers usually to begin with…and shouldnt they know how to draft a clear and concise bill….if not they shouldnt be in that line of work!

      Binary triggers would be out. Besides, they are a waste of ammo. Competition or light triggers DO NOT INCREASE the firing rate. The limitation is how fast your finger moves no matter if it’s 5f pull or 1.5#.

      Rather than “laying down a spray…” I prefer to start picking them off at 1500 yds. with a 6.5×284 rem. 700. Switching to an M1a at 500 yds. The AR at 300 yds. And the 1100 rem. 12 gu. At 50 yds. You’ll find at 1500 yds. When an enemy sees his comrades heads explode… they tend to find anything possible to hide behind. A precision rifle has that advantage to slow an enemy down. However, reality kicks in and I discover we’re not under attack. Bump stocks have no use beyond wasting ammo. The NRA should have given this fight up… stay focused and fight those libertard mocks that really matter.

Those of us that have been in that position know that your comparison is not valid. If you had 1500 yards…you would be correct…no “bump fire” is effective…give me a “sniper” set up..but when multiple aggressors are in closer range..I’ll take the ability to use bursts of fire made possible by a bump stock.

        Training and experience should dictate how a weapon is used or which weapon is used…not ignorance of true combat or defensive tactics…or emotional reactions..by those not informed. Period!

    It would probably just be easier to ban AR-15s, particularly since one cannot ban belt loops and thumbs, as has been helpfully pointed out several times on this very blog.
    I honestly don’t think that binary triggers belong in the same conversation as bump stocks and pistol braces, though.

      As to it being easier to ban ARs, I don’t think at this stage anything of that nature could be easier. You would make criminals out of good people, and many would just hide them for that rainy day.

        I am not really bothered by binary triggers. They aren’t a way to circumvent any of the major firearm restrictions, like making a backdoor SBR or counterfeit full auto, so I don’t really think they fall into a category of firearm accessories that needs to be addressed. Binary triggers just separate the acts of pulling and releasing the trigger, which are very definitely separate acts, and therefore not something sneaky or shady. Trigger modifications are not necessarily a bad thing except when modifying a factory trigger on a 700 or unless you are trying to simulate full-auto fire like with the old Hellfire triggers. In most cases, replacing the trigger is the first and easiest way to improve performance on a firearm. It does not sound like a modification that I would want to make on my own rifle were I to own an AR, quite the opposite, but the binary triggers don’t obviously cross any lines.
