Florida HOA Tried to Ban Guns

You know an HOA has gone too far when even people who normally ignore HOA drama suddenly start paying attention.

This week, Colion Noir unloaded on a Florida homeowners association after residents in the Tradition community of Port St. Lucie received a letter announcing firearms were no longer allowed in common areas: including parks, trails, gazebos, and yes… the splash pad.

According to Noir’s breakdown, residents weren’t exactly thrilled to find out their carry rights had been quietly “updated” through a neighborhood letter instead of an actual public discussion.

“They slid a right out from under you in an envelope,” Noir said. That pretty much sums up why the story exploded online.

Noir’s biggest point wasn’t really about whether the HOA technically has legal authority. In fact, he admitted the situation is murkier than many gun owners probably want to hear. Because HOA common areas are technically private property, the Second Amendment restrictions that apply to government entities don’t always apply the same way to private associations.

That’s the uncomfortable part. But Noir argued the bigger issue is the mindset behind it all.

“You don’t need a dictator,” he joked. “You just need a [bleep] HOA.”

Honestly? Somewhere deep down, every homeowner reading that probably nodded a little.

Things escalated fast after state attorney general James Uthmeier publicly warned the HOA the policy could violate Florida law and threatened legal action if enforcement continued.

Florida HOA gun ban. If it can happen in the Gunshine State, it can happen anywhere.

Meanwhile, local police reportedly clarified they enforce state law, not HOA policy letters.

Noir says the entire controversy should serve as a warning to gun owners who assume “friendly” states are permanently safe territory.

“This did happen here. In Florida,” Noir said. “Reputation doesn’t protect the right. Vigilance does.”

Whether you agree or not, watching a homeowners’ association attempt to regulate concealed carry with the same energy they use to fight over mailbox colors is objectively one of the most 2026 stories imaginable.

    There have been so many articles and incidences where HOA’s in Florida have just completely ripping off their people. Their monthly in some of those places is more than my Mortgage and I don’t live in a dump. My HOA fees here are $65 a year but my problem is an HOA. Nobody wants to upset one of their neighbors so nobody wants to take over the chair and then actually do the job for fear that they won’t be “liked”. Yes I’m dealing with a bunch of liberal pussies in my neighborhood.
    They seem to pick and choose what rules and regulations they’re going to allow including some people to have three dogs, an in-law suite built into their home and unlicensed junk vehicles in the driveway. All three of which are illegal according to the HOA regulations. They also allow renters which goes against what the builders allow which is not addressed in the HOA regulations. Apparently they felt they didn’t need to put it in there since the builder already said no to the purchase of a rental properties and yet… We have those to.
    So when I go to put in a pool house… I’m not even gonna let them know lol.
    The biggest thing is when you want to add a new rule or regulation to the covenant, it has to be 100% unanimous and voted on by every person that owns a home in the development. The board cannot make that decision on their own without a vote. How is this shit getting passed in Florida? Choose your neighborhood wisely!

    I wouldn’t exactly call Florida “gun friendly”, since they ban bump stocks and other fire-rate enhancers legal under federal law. Gun friendly, in my book, means “own whatever the hell you want to as long as you use it in a legal fashion”.

    The acronym HOA actually stands for Holes Of the Asses. The people who participate and lead these groups are literally morons. Worse they are morons with an inferiority complex which compels them to attempt to control others’ lives. You could say they are communists. Fortunately we are protected from these morons by the US Constitution. The so-called “rules” these idiots contrive are still and always subject to the Constitution.

    These fucking clowns need to wake up and realize that Florida like Texas is a purple state. Your Governor has given the state to the left year after year. He literally pays Puerto Ricans on subsidies. Huge dividends to move to Florida, a group well known for being far to the left and wildly anti-gun

    The governor did nothing for gun rights until his term was nearly up and he needed to preserve his parties best interest.

    You’re an absolute fool if you think Ron DeSantis gives two fucks about your gun rights and it’s not a competition or a him versus them. So the laughable argument that he’s better than Democrats is idiotic at best

    I have honestly NEVER heard of anything good coming out of an HOA. I honestly can not even begin to imagine why anyone would ever belong to one. Regardless, once HOAs were allowed to prohibit veterans from flying the American flag, it was inevitable that other rights restrictions would follow. It honestly would not surprise me to find them banning possession of a firearm on your (so-called) property. They can tell you just about everything else you can and can’t do on you property as it is.

    I think the HOA has just knee-jerked the ban without thinking it through. Let’s say there was an incident that could have been mitigated or prevented by an armed citizen or against someone disarmed by this policy. I think we could see a very favorable jury selection for a judgement against this HOA. This is Florida after all. And for those living at Traditions you get to vote these people out. Do it.

    I would never even consider living under the auspices of HOA rule. Anyone who does is probably ball-less. To let someone who you haven’t elected tell you what to do is simply un-american. We are free people! I implore you all to take down HOA’s everywhere.
