Authors Defensive Use of Firearms Kimber Pearce This Week

A delivery driver and passenger were involved in an incident earlier this month when a homeowner shot at them. No charges have been filed.

Waldes Thomas Jr., 19, and Diamond Darville, 18, were attempting to deliver groceries for Instacart. Mistakenly, they drove onto the 2-acre property of Antonio Caccavale, 43.

According to a police report from the Davie Police Department, the couple was “on the phone with the customer, trying to find the right address” when they arrived at the wrong location. Officials say that their desired destination had been across the street.

Caccavale, the homeowner, was interviewed afterward. He’d instructed his teenage son to ask the delivery people to leave. He says he then heard his son call for help, says ABC6.

According to the police report, Caccavale claimed that the driver was driving erratically and began running over logs, boulders, and a fence on his property. He approached the car, fearing for his safety and that of his son.

When the car allegedly ran over his foot, Caccavale pulled out his handgun. He shot several rounds toward the tires of the vehicle with a Smith and Wesson Shield, says NPR.

The delivery driver, Thomas, gave a different story. He said he tried to leave the area after being asked to by Caccavale’s son. “Caccavale approached them aggressively” and they heard three close gunshots.

The couple left the scene following the shooting. WRAL News claims that at first police were not informed of these events. It was only once an interview with the couple was released that police looked into the incident.

Davie police found no need to file charges because “each party appears justified in their actions based on the circumstances they perceived.”

    should be easy to figure out. if his foot looks like a bear claw then he is, if it looks okay then she is.

    A bit quick on the shot I believe. Shooter very lucky nothing went further. Those very emotional events should be settled with a more cold blooded mind than that otherwise bad things and huge trouble could happen fast. Too late to realize that when your life will be put to pieces by some zealous prosecutor.
