Lawmakers Reintroduce Bill to Bankrupt Gun Manufacturers, Dealers

One of the primary goals of anti-gunners is to bankrupt the gun industry by repealing the Protection of Lawful Commerce in Arms Act (PLCAA). Rep. Adam Schiff (D-CA) and Sen. Richard Blumenthal (D-CT) reintroduced legislation this week that would do just that.  

Rep. Schiff and Sen. Blumenthal call their bill the, “Access to Justice for Victims of Gun Violence Act,” and say it allows victims to have “their day in court.”  

“Our simple measure will give victims of gun violence their day in court and unlock the doors to justice —repealing the sweetheart deal that Congress granted to the gun lobby,” said Sen. Blumenthal, referring to the PLCAA which was enacted in 2005.

Rep. Schiff, added, “This bill would pierce the gun industry’s liability shield by putting an end to the special protections the gun industry receives when they shirk their fundamental responsibility to act with reasonable care for the public safety. Victims of gun violence deserve their day in court.”

Schiff and Blumenthal are grossly mischaracterizing the purpose of PLCAA.  It does NOT protect members of the gun industry from product liability suits for manufacturing or design defects or certain types of negligent conduct. It merely prohibits lawsuits against gun makers for damages resulting from the third-party criminal misuse of their firearms.

The PLCAA is common sense.  So much so that even Comrade Bernie Sanders gets it.  While debating Hillary Clinton in Flint Michigan in 2016, the Bern-Man explained why he voted for the PLCAA more than a decade ago.  

“If I understand it, and correct me if I’m wrong, if you go to a gun store and you legally purchase a gun, and then three days later you go out and start killing people, is the point of this lawsuit to hold the gun shop owner or the manufacturer of that gun liable?” Sanders asked.  

“If that is the point, I have to tell you I disagree. I disagree because you hold people in terms of this liability thing where you hold manufacturer’s liable is if they understand that they are selling guns in an area getting into the hands of criminals, of course they should be held liable,” Sanders continued.

Sanders went on to say that if gun makers and dealers are going to be held accountable for the rogue actions of killers then “what you are really talking about is ending gun manufacturing in America.”  

Bingo.  That’s exactly what the goal is.  Ending gun manufacturing in America.  

To an extent, we’re already witnessing this in Connecticut.  Parents of Sandy Hook massacre victims are suing  Bushmaster Firearms International, a subsidiary of Remington, claiming that the gun company is responsible, in part, for the December 2012 tragedy that left 27 dead.  

Back in March of this year, the state Supreme Court ruled that the lawsuit could go forward despite the protections of the PLCAA because the company’s advertising may have been unlawful under Connecticut’s Unfair Trade Practices Act.

In other words, it wasn’t his severe mental illness that propelled the killer to gun down his mom, 20 school children and six staffers, it was Bushmaster’s AR-15 ads.  If we accept that logic the Beatles should be in jail for the Manson murders.  After all, it was their music that made Manson do it. Right?

Even with the PLCAA in place, gun manufacturers are already targets of frivolous lawsuits.  Strip it away and it will be, as Comrade Bernie said, the end of gun manufacturing in America.

    Using their logic the victims of drunk drivers should be able to sue the company that made the beverage that the drunk driver was drinking.
    If this was to pass a person could sue the manufacture of any item that could be used as a weapon. Could be anything from a baseball bat manufacture to a screwdriver manufacture.
    Heck a person could sue the manufacture of the parts of a product that was used to commit a crime.
    This logic makes no sense at all.

    Only Congress could formulate a law that penalizes a manufacturer for producing a device that operates exactly as advertised.
    While most of this is just noise for their supporters to improve their standing, this does make for a serious question: Could this law be turned on other manufacturers, to their detriment? If one bought a…blender and while it worked perfectly the owner got splashed because they left the top off…could they use the premise of this proposed law to sue the manufacturer – even though they ignored the instructions (and common sense)?
    Meh, I suspect that this proposed law is window-dressing since we’re approaching an election year, but this is the sort of thing we need to watch. Remember Prohibition? That was a stupid law too, and it passed. Let the politicians posture to get elected but watch what they’re saying.

    Why would we hold a manufacturer complicit in the massacre of people by a deranged underage killer. If anyone is complicit it would be the owner of the weapons who failed to secure their property. I am a believer in responsibility. We are all responsible for our actions. But if I, a gun owner legally purchase a weapon, then I am responsible for that weapon. That is why I bought two gun safes. To control tools that can be used to protect my property. When I fail to control that property, then I am liable, not the manufacturer of the tool.

    So, don’t stop with guns. How about cars, trucks, ski masks, knives, baseball bats, etc. If it is used in a crime, the manufacture s/b able to be sued. Heck, how about shoes. If they didn’t have them, they would be able to run away as fast after committing a crime.

Automobiles, heavy machines, power tools, alcohol, drugs are the obvious ones. Just wait until the family of someone killed by a drunk driver goes after GM and Anheuser-Busch using one of these gun lawsuits as precedent.

    Remington needs to demand copies of birth and death certificates for each of the allegedly dead children. Wolfgang Halbig demanded this of the father of an allegedly dead Sandy Hook victim that sued him, and the suit was swiftly dropped.

      Read the entire 2nd Amendment and you might understand gun ownership is “NECESSARY” for the “regulated militia” to even exist. Yet you claim that the left should be able to vote away our constitutional rights rights because they some how are the “regulated militia?” Since the right is currently in power can the right be considered the “regulated militia” today and vote away the lefts right to free speech?

    Here we go again. But isn’t this country still a Democracy ? We need to be fair to ALL about this banning products that hurt and kill: Guns, sure I get it, but don’t stop there. Wine, beer, cigarettes, fast cars, slow cars, motorcycles, knives, airplanes, cell phones, baseball bats, …anything that can or has killed, make it go away. So it’s an inanimate object, so what, never mind it’s not the object , but the user.

    Oh the light just went on: We are loosing our democracy. It’s ban what liberals don’t like, but keep what they do. I get it now. Seems common sense no longer exists. Man, what direction are we heading….

        In today’s definitions of the words, we’re a “democratic constitutional republic.” That’s a unique form of democracy that protects the rights and freedoms of minorities from the tyranny of a majority … by the Declaration of Independence, the Bill of Rights, States Rights, the three branches of government, requiring 3/4 of the states to amend the Constitution, and the electoral college. These protections (should) protect our Constitution right to bear arms … but we’ve seen that bureaucrats, elected officials and judges who don’t respect the Constitution still try to take away our 2nd Amendment right.

When a drunk driver kills someone in an accident, everybody blames the driver and not the car, why is that? I think it is because we know the inanimate object is not to blame for it, but the operator. But when it comes to guns, they want a double standard. This time we’ll blame the inanimate object, and not the operator. It is insane.

    Firearms are a threat to liberals. An enumerated right for a reason. They know in order to consolidate power means the complete disarming of the citizenry

    One only needs to look at Venezuela and see what happens when citizens gave up their rights. There are other examples, but liberals seem to have forgot much.

    Makes as much common sense as allowing victims/families to sue vehicle manufactures for drunk driving, reckless driving and road rage losses. Ads: fast 0 to 60 in X.X second, torque run over obstacles, pull (=push) heavy weight. Carry heavy loads explosives. As a matter of fact: vehicles have been used to deliberately run over innocent civilians, truck/car bombs and the run of the mill DWI with single or multiple fatalities and injuries. These events happen in the U.S.

    Once again a very targeted anti gun policy. If their concept was even handed and all mfr, retail and wholesale business could be sued for any and all misuse of products by purchasers: they would be dragged out of office.
