BREAKING: ATF to Start Confiscating These Today!

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is coming after certain aftermarket triggers starting now, according to leaked emails from the agency obtained by Gun Owners of America.  

Specifically, ATF agents are going to start confiscating Rare Breed’s Forced Reset Triggers (FRTs) and BDU’s Wide Open Triggers on the grounds that they are unregistered “machine guns” in violation of the Hughes Amendment.  

“Please be prepared to take possession of any documents and FRTs the manufacturer, distributor or retailer offers to surrender.  They may choose to abandon the items in which case give them a forfeiture of property notice,” states one of the leaked emails, per GOAs alert (see video above).

“If the manufacturer/seller refuses to abandon the items, please take custody of the items, and seize them for forfeiture so that they can be properly noticed,” it continues.

GOA also notes that in the correspondences ATF refers to those in possession of FRTs as “defendants,” suggesting that they’ve already committed a crime.  

Per federal law, possession of an unregistered “machine gun” is a felony offense that carries with it a prison sentence of up to 10 years and a fine not to exceed $250,000. 

“With its new reckless interpretation that FRTs are machine guns, ATF is playing games with your life,” said Phil Reboli, senior policy advisor for GOA.

Rare Breed’s FRT-15 works mostly like a normal AR-style cassette-type trigger pack. It’s a drop-in assembly with one extra function: after a round is fired and the bolt cycles, it cocks the hammer and at the same time, resets the trigger, as GunsAmerica previously reported.  

That’s how the FRT-15 gives shooters the ability to repeatedly pull the trigger quickly, similar to how practice with a light trigger can also be used to shoot rapid strings of fire. According to the law, a machine gun isn’t a gun that can be fired quickly, it’s a gun that fires more than one shot per pull of the trigger.

However, last Summer, ATF’s Technology Division departed from the conventional interpretation and classified FRTs as “machine guns.”  Now, any manufacturer, distributor, retailer or consumer in possession of an FRT is a target of the agency.

For those who think a run-in with the agency can’t happen to them, they ought to consider the story of Sacramento fire captain Derik Oakes.  

In 2019, ATF got wind that he was in possession of an “80% Glock Auto Switch” and came knocking on his door.  Though Oakes obtained the device prior to the ATF’s 2018 determination on its illegality, it didn’t matter.  Oakes, who is by all accounts a standup citizen, was still put through the wringer.  

Oakes was charged with multiple felonies and his firearms were abruptly confiscated.  Last we spoke, he was still fighting the charges in court.  

“You think you’re doing the right thing, and you’re not,” Oakes said in a 2021 interview with GunsAmerica. “The ATF can just change their mind on something, get a warrant, and come to your house.”

    Love the comments below. I’d wager many don’t care one whit for owning the device in question, but what I read from people (in possession of logic) is that the law matters and the ATF does not have the authority to change it. There is no such thing as a loophole, there are simply laws with varying degrees of scope and detail. There is also the fact that trying to write legislation to address every element of every conceivable object, behavior or intent is a fool’s errand, yet somehow that’s what our elected officials try to do. I’d wager that each and every one of is subject to about 150,000 laws/rules if you start counting from your HOA , through your city, county, state and on up to the Feds. If we fired all lawmakers right now, freezing all laws where they are, at every level, we might have a hope of finding some sort of stability/sanity as a society.

      No person thinks the founding fathers were gods. Even the founding fathers didn’t think of themselves that way. They KNEW that the Constitution they crafted would need to be amended from time to time.
      So they put in a way to do just that! (now THAT was pretty smart of them)
      The 2nd Amendment, which we are all fighting over – WAS one of those changes to the Constitution.

      I don’t mind people discussing whether or not we should change or do away with the 2nd Amendment – I just hate idiots who think that making those changes happen simply by passing laws that violate the Constitution.

      Mr Bones – you are wrong that the founding fathers did not consider advancement of technology in the arms industry. They were historians, and as such understood that tyrants have always (and thus would always) exist in our fallen world. When the Kings’ armies had swords and spears, they confiscated the civilians’ swords and spears. Then bows and arrows, then muskets and canons.

      The founding fathers SPECIFICALLY used the word “arms” instead of specifying what types of guns or knives or swords, etc – because they DID know that technology would continue to advance – and the Kings’ armies would always have the most advanced weapons…… and so, the civilians should also.
      Someday, when the King’s armies have light sabers – the civilians should also own light sabers.

      ….. lastly – the way that the Constitution gets changed is by amendment. Not by simply having alphabet agencies violate what the Constitution currently says. THAT is called tyrany and it is exactly why our founding fathers did include the 2nd Amendment.

    The worst part of this is the ATF approved the Rare Breed’ trigger design and said that it conforms with the law and does not turn a rifle into a machine gun. ATF was beaten in court the first time they did this and will be beaten again. However the company will be bankrupted in the fight and the ATF will win anyway.

      Rare Breed Triggers never submitted their trigger design to the ATF for review. They stated as much on their website (don’t know if it’s still up). RBT said that they felt they didn’t need to submit their design to the ATF because they had 3 experts, who previously worked at the ATF and who were involved in determining the legality of such accessories, write opinions stating the design did not fit the definition of a machine gun…which it does not. However, the ATF will just change the definition.

      I’ll never understand how an agency with no elected members was given the ability to decide if someone is a felon after the fact. They can literally make millions of people felons, overnight, with the stroke of a pen, which is the definition of tyranny. They tell you that something is legal, so go ahead and spend your hard earned cash on it, only to change their mind and tell you that if you don’t hand over your property, that you paid for and that THEY said was legal, then suddenly you’re a felon, go straight to jail.

      I fear that this is a trial run to see how many people will be subservient to their authority, in preparation for a full scale registration attempt by way of pistol braces and 80% receivers.

      What we desperately need is a SCOTUS case challenging the ATF’s authority to write criminal law that makes a citizen into a felon at the whim of bureaucrats. This is a freaking right directly protected by the Bill of Rights and we have come to a point in which we are allowing some hired/appointed desk jockeys to effectively write Federal Criminal Law without the involvement of Congress.

      The doctrine of Chevron Deference was
      never meant to apply to criminal law. We need the help of SCOTUS on this one in a bad way or I don’t see it turning out well for the 2A.

    I beat the drum non-stop during the comment period of the TRUMPSTOCK BAN to get fellow patriots to wake up, but most were of the opinion that Trump would never hurt us, or that he was playing 3D Chess, and the ban, and the 1934, 1968, and 1986 NFA bills, would be declared unconstitutional by the Supreme Court.

    BTW, I am still waiting for suppressors to be removed from the NFA list, AND / OR National Repricrocity, as we were PROMISED in the run up to 2016. We did our part, and got a majority in both the Senate and House, and elected a supposedly 2A President, who banned BUMPERS!!!

    For the 2nd amendment community that insists the law does not mean what the people who wrote it said it meant, here is something to consider.
    The purpose of the 2nd, according to the Founders, and later court decisions was to “to assure the continuation and render possible the effectiveness of such forces”. Such forces being the constitutional Militia clearly written into the original Constitution. The one that is staffed by, and controlled by “We the People”. Not the fictional “voluntary militia” that never existed until the later part of the 20th century. The one that has no authority, no means of strategic support, and is staffed by a bunch of people who are aiding and abetting groups such as “Everytown” in their quest to disarm the American people.
    Now, if we had the real, actual, lawful Militia manned by able-bodied men, those ATF agents would be subject to arrest, and everyones RKBA for the purpose of carrying out the Duty commanded by the Constitution would be secure.

    I’ve loved guns – including machines since I was a child. Raised in a family of U.S. Army combat officers whose lineage dates back to the Alamo and further back to the Revolution. And of course, I have served in war and shed my blood for this country. I side with the ATFE. I side with the government. I side with the entire constitution, not just a phrase in a single amendment.

    I believe the government and the people are one and that it is not an adversarial relationship. I became a police officer to serve my State and my community to proect and truly serve. I chose to be an Internal Affairs Officer to protect the people and the intergrity of police work from those who would sully the badge – and I was always busy in that regard.

    I was born and raised a Catholic, but my country comes before Jesus. What’s right and what’s wrong comes before my job, and the law comes before my personal predilictions. I subscribe to Gunsamerica because it is a reliable source of gun-related news, even though it is necessarily inclined to the political right wing.

    This is America, everyone has the right to be politically right wing, and even unpatriotic. They even have the right to be the psychotic, hate-filled, ignorant, violent, distinctly unamerican looney toons that I see on this venue. But when you break the law, you cross the line, and the law will come for you; and the law will win. They will win despite your juvenile fantasies, your black rifle and bizarre, absurd philosophies. You will wind up as a jailhouse lawyer with the biggest mouth on the tier. And some of your fellow inmates will want make good use of that mouth.

      One of the things you said deserves An answer so here is your statement and you can answer it by pointing out the enumerated power that authorizes Congress to over reach and invent new “regulatory” alphabet agencies such as the BATF. After all, the ONLY POWERS of our government authorized by the people are those specifically enumerated within the Constitution. The ratification delegates even went so far as to demand, as a condition of ratification, the amendments that constitute the Bill of Rights and you ought to take a look at the 10th amendment in particular.

Bump stocks, drop-in seres, 80% Glock backplates and these particular reset triggers are just a way to achieve multiple round burst/fire while finding legal loopholes. At some point you have to expect the government to close the loophole and make them illegal. With the price of ammo these days, do you really need a full auto AR? If you do, come up with the money and buy one legally, then you won’t have to worry about all of this BS.

      It just amazes me as to how little so called experts know about design and function and you obviously know nothing about it. This trigger is nothing more and nothing less than just a trigger. Legal in every aspect as to the definition of “semi automatic”! There is another company with a very similar function that has a patent and the ATF has declared it a legal trigger, FACT! He has 3 former ATF agents employed by him that have all agreed that the trigger functions under legal guidelines. Apparently that is real hard for some of the communists on here to understand. The owner of the FRT is a lawyer as well and his production and offices are all in the same building in FL. I am a gunsmith and read constantly about new products coming to the market, some are junk, some are just novelties and some are very innovative. Who the hell are you to tell people what they should be allowed to own? The ATF needs to be gotten rid of, they have overstepped there authority and are not law makers, they can’t just arbitrarily change their minds every other day and make legal components illegal.
