Colorado Gun Groups File Federal Lawsuit Against Colorado’s Homemade Firearm Ban

In a bold move defending gun rights, Rocky Mountain Gun Owners (RMGO) filed a federal lawsuit yesterday.

This legal action directly challenges the constitutionality of Colorado’s recent ban on homemade firearms, as outlined in Senate Bill 23-279. The lawsuit, filed in federal court, seeks to overturn the ban, citing violations of Second Amendment rights.

RMGO, along with three of its members and the National Association for Gun Rights, have joined forces as plaintiffs in this significant legal challenge. They argue that the ban infringes upon the fundamental right to keep and bear arms.

Taylor Rhodes, a representative of RMGO, passionately criticizes the law: “This law is an outright assault on the constitutional rights of peaceable Coloradans. It’s not just an overreach; it’s a direct defiance to our Second Amendment freedoms.”

Rhodes expresses confidence that the law will not withstand legal scrutiny, especially considering the recent Supreme Court decision in Bruen.

The lawsuit references the Supreme Court’s decision in New York State Rifle & Pistol Association v. Bruen, establishing a precedent.

This ruling dictates that gun control laws must align with the nation’s historical approach to firearms regulation.

The Bruen decision, importantly, limits judges from considering government arguments that justify firearm regulations by their perceived benefits over the constitutional burden they impose.

“In the Bruen decision, the Supreme Court made it clear that any law infringing on the right to bear arms must align with the historical understanding of the Second Amendment. Senate Bill 23-279 clearly does not meet this standard. If homemade – unserialized – guns weren’t legal at the time of our nation’s founding, we would all have a British accent,” Rhodes emphasized.

RMGO contends that the new law unjustly affects gun enthusiasts, collectors, and hobbyists who lawfully create and possess homemade firearms. They argue that the bill is vague and disproportionately targets law-abiding citizens.

Rhodes asserts the importance of the ongoing battle for constitutional rights: “The fight for our constitutional rights is never easy, but it’s always worth it. We’re committed to ensuring that Coloradans can exercise their Second Amendment rights without undue governmental intrusion. This lawsuit is a testament to that commitment.”

RMGO is rallying support from gun rights advocates nationwide to join their challenge against what they deem an unconstitutional law.

The outcome of this lawsuit could have far-reaching implications for gun legislation and Second Amendment rights across the United States.
