Everytown Files Amicus Brief for SCOTUS Case, Supports Restrictive CCW Standard

Everytown for Gun Safety, this week, filed an amicus brief (see below) in support of New York’s restrictive “may-issue” permitting system.

The Supreme Court is currently scheduled to hear a case, known as NYSRPA v Bruen, examining whether it’s constitutional for New York to deny a law-abiding citizen a concealed carry permit for self-defense under the state’s “proper cause” requirement.

Everytown contends that the “proper cause” requirement, which in practice allows local officials to arbitrarily deny one his/her right to bear arms, is not an infringement and has been the norm around the country for decades.  

“Here…not only is there a long tradition of regulating public carry, but even the uncontested history is longstanding: The petitioners do not dispute that dozens of states and cities from the mid-19th-century to the early-20th century enacted laws that were at least as restrictive -4- as New York’s law. When this unrebutted history is added to the long tradition of public-carry regulations, there can be no doubt that New York’s law is constitutional,” Everytown writes in its brief.

The challenge to New York’s may-issue standard was filed by the New York State Rifle & Pistol Association and is backed by the National Rifle Association.

Cutting to the heart of the matter, the NRA believes that “law-abiding citizens should not be required to prove they are in peril to receive the government’s permission to exercise” 2A rights. 

Everytown, however, believes allowing citizens to bear arms in the way the Founders and Framers intended is a “distorted telling of history.” 

“In this latest attempt to force their dangerous views on the Second Amendment on the rest of the country, opponents of strong gun laws are relying on a distorted telling of history,” said Eric Tirschwell, executive director of Everytown Law, the litigation team affiliated with Everytown for Gun Safety. 

“The last time this NRA affiliate argued before the Supreme Court, just two years ago, it was unsuccessful in advancing its extreme and dangerous position,” he continued. “While the court’s makeup has changed since then, the Second Amendment has not. As communities across the country grapple with increased gun violence, it’s particularly important that the high court get this case right, too.”

SCOTUS will hear the case during its 2021-22 term.  Stay tuned for updates.

    The problem of showing need to get a CCW permit is by then it’s probably too late.

    I’m sure the forefathers wrote the second amendment so that our government like the government they we’re running from could tell you when and where you could have a firearm. Right along with the “ well regulated” meaning it could be regulated also. These dirtbags will twist absolutely everything to jump in the arms of communism. These people need to be deported to communism countries if it is so great. Useful idiots. Even after all the so called “peaceful protests” they still feel this way? I call bullshit. Who’s pulling the strings. Money is the root of all evil land it is showing everywhere. These people would sell their souls to not have to work for a living. Just get paid to destroy the greatest country in the world little by little from the inside out.

      Another Genius with his ignorant unschooled uninformed opinions and spouting the absurd illogical arguments relating to the 2nd…but thats why the founding fathers felt the population at large was in need of Guidance and Oversight – so people with limited abilities to think objectively could be modified by those with a higher intelligence and cognitive abilities,
      The one think you stated that is unquestionably true and thats money influences and mostly controls all now – greed. And i maintain the need to control and regulate big businesses (just as we regulate gun ownership) – and its not “sour grapes” like JR, I’m in the rich category. Tax Reform is Necessary, roll back that idiot self-serving autocrat Trump reductions, which as a wealthy person, I benefit, but it is BS and widening the gap which will someday blow the whole system apart!

    CCW holders are not a criminal bunch perhaps, starting with inter city crime would go a very long way in reducing gun deaths.

    Funny, when a case came up two years ago, the Court held that the matter was moot after NYC amended its restrictive (and likely unconstitutional) transportation law that had essentially prohibited anyone from leaving the City with their firearm(s) without police permission. To suggest, as Everytown does, that the Appellants somehow lost is disingenuous at best, and an outright lie at worst. The only win for respondents was that there was no opinion detailing the scope of the second amendment.
