Common Sense = Confiscation in Los Angeles, as Magazine Ban Passes

2nd Amendment – R2KBA Authors S.H. Blannelberry This Week

The city of Los Angeles just approved a confiscatory ban on magazines that hold more than 10 rounds of ammunition. Law-abiding citizens will now have 60 days to either sell off (to a licensed gun dealer), turn over to police or render permanently inoperable any legally grandfathered magazines capable of holding 10 or more rounds.

Basically, the government is telling responsible citizens to destroy their lawfully-owned private property because the government believes that these magazines in the hands of, again, law-abiding residents are a threat to public safety.

Los Angeles Mayor Eric Garcetti, who signed the statute last week, told USA Today that the magazine ban is a “common sense” measure that should be imposed “nationwide.”

At the signing ceremony, Garcetti added that the bill will help save lives.

“I am committed to reducing the gun violence in our city,” Garcetti said. “This ban is part of that larger effort. It will help keep our streets safer and help prevent the magnitude of mass shootings. We are sending a clear message – we will not wait for Washington to act, we are ready to act now.”

Not surprisingly, in a statement the nation’s gun lobby panned the measure, arguing that it will do nothing but restrict the rights of responsible gun owners.

“This ordinance will not prevent violent crime or mass shootings, but it does limit the Second Amendment rights of law-abiding gun owners who choose these magazines to defend themselves and their families,” said the National Rifle Association in a statement.

“As most gun owners already know, magazines holding more than ten rounds are standard equipment for many popular pistols and rifles, especially those that are selected for defensive purposes. These standard capacity magazines are possessed by millions of law-abiding Americans for a variety of lawful purposes, including self-defense,” the statement continued.

Gun-rights advocates will certainly call into question the notion that the ban is Constitutional, let alone common sense, but the attorney for the city who penned the measure said he is confident it will fell any legal challenges.

“We have considered the possibility that the second revised draft ordinance might be challenged on the grounds that it is preempted by State law or violates the Second Amendment of the United States Constitution,” Feuer told the LA City Council. “We believe the second draft ordinance is legally defensible on both grounds.”

There are several exemptions for the new law: law enforcement, Hollywood prop masters, gunsmiths, museums and anyone with a grandfathered magazine to a weapon for which there is no 10-round magazine produced.

For moderate gun owners, if there was any doubt about what gun-control advocates mean when they talk about “common sense” measures this latest magazine ban should hopefully remind them that common sense is just another way of saying confiscation. That’s the goal. Don’t be fooled by agreeable rhetoric. The truth is that they want your guns, magazines, ammo. The main targets now are black rifles and magazines over 10 rounds. Next will come handguns and semiautomatics. And on and on until we’re no different then Australia or England with respect to gun ownership.

I imagine that this is well documented, well recearched, and obviously well thought out. It should be easy to answer a question that, to my knowledge, has never been addressed.
In what percentage of shootings has every round in a magazene been fired?

If you want to pay excessive taxes and watch your money being wasted by career politicians who want to control every aspect of your life, stay in CA. A large number of those new jobs in TX were, in fact created by the government of CA.

  • Hank August 18, 2015, 6:50 am

If you live in California, you do NOT need to turn in your illegal 30 round magazines…they are undocumented. It worked for the aliens why not you?

  • Steve August 17, 2015, 5:30 pm

How many of the Bloods and The Crips have turned theirs’ in so far? Another stupid misguided law designed to lul liberals into a false sense of security.

  • Francis Romero August 17, 2015, 4:59 pm

Limiting mags to 10 rounds is absolutely ridiculus. The author of this ordinance has no common sense at all. One can easily connect or attach 2 mags together and come up with a 20 round mag. No one can stop someone from killing a lot of people by just limiting capacity of a mag. The only way to end killings with the use of guns is to ban all kinds of firearms which will never happen.

Calling all Rapists, Robbers, Murderers and Criminals of any nature: Los Angeles Welcomes you! Here, you will encounter unarmed, poorly prepared Victims who will be Easy Prey! Come One and All!

  • Chris August 17, 2015, 3:44 pm

I believe I’d just quietly keep my 11+ rounders and let LA KMA.

  • december August 17, 2015, 12:31 pm

Sorry don’t have to obey as it is against my religious belief. Heck, if government officials can hide behind that then it is good enough for the rest of us.

  • Chief August 17, 2015, 11:39 am

Kalifornia is such a retarded place .Its no wonder all the trash socialist actors live there .

  • Rick August 17, 2015, 10:37 am

The government in L.A. is missing the total concept of being safe. The criminals won’t turn in any magazines, they don’t care about any laws. Wake up mayor, law biding citizens are not committing the crimes, Thugs, Gang members, Felons, etc. are the cause. You are barking up the wrong tree, just like Bloomberg, Clinton, the Pres and others. The real truth is to Disarm the american public so they have no way to protect themselves from the invading illegals, and others.

In the land of fruits, nuts, and flakes, there is little “common sense.” Glad I moved away 42 years ago, and a couple of years ago, vowed never to return to provide the “CRAZIES” any more tourist money on which to perpetuate their craft. It is hard to believe that with the many thousands of sane people in The People’s Republic of Kalifornia, these lame-brained schemes still occur. The progs and dimocrats have certainly taken hold. Such a beautiful place too. What a shame. Maybe someday they will learn?? But, I doubt it!

A sherriff in Indiana has posted a test on YouTube that demonstrates the fallacy in thinking that it takes significantly longer to shoot 30 rounds using 10 round magazines in a handgun. It also lays to rest the idea that the perp can be tackled during magazine changes.

Exactly why this is only the beginning, next only can own guns without detachable mags because murderers can quickly swap 10rd mags out

  • Rob August 17, 2015, 9:15 am

Common sense, common sense tells me no thief, bank robber, murderer or just plain thug, is going to hand over his/ her gun or magazine !

  • Jim August 17, 2015, 9:06 am

“Keeping focus on the big picture” as quoted by the guy in the video, the amount of rounds in the weapon did not contribute to the child’s murder. BLACK GANG VIOLENCE and BLACK on BLACK killings did. Gee, no mention of that issue in the video? Besides the supreme lib-tard lunacy of the argument is DO YOU REALLY THINK THIS FEEL GOOD LAW WILL EFFECT CRIMINAL BEHAVIOR????? Those who support this ignorant ban are the same twits that would support a drunk driving ban by making it tougher for SOBER people to buy a car!!!!!!!! Complete and utter stupidity!!!!!

  • Barry August 17, 2015, 8:41 am

they could sell them to us for a dollar

    • Chris August 17, 2015, 4:08 pm

      I Second THAT! 🙂

  • Infidel7.62 August 17, 2015, 8:20 am

Why are Hollywood prop masters excluded? What pressing need is present that makes them exempt?

  • Bob Peck August 17, 2015, 7:38 am

So with the passage of this law what is the next step when none of the law abiding citizens comes forward to turn in a magazine? House to house searches to find the magazines?? Does LAPD have a lot of free time on their hands to conduct unlawful searches of law abiding citizen’s homes?

How can these liberal democrats come up with something like this?? Anybody with just an ounce of common sense would realize that this law will have absolutely no effect on lowering gun violence in LA nor is it constitutional. Oh wait, that is the key. Liberal democrats do not have an ounce of common sense!!

  • robert August 17, 2015, 7:21 am

I guess the criminals are lined up to turn them in. More idiotic restrictions on law abiding people. California is out of control

  • Mick Dodge August 17, 2015, 5:34 am

I hear as long as you can’t read English and vote socialist you are exempt from the law.

  • slacking August 13, 2015, 8:16 pm

Do you hear that Crips, Bloods, MS-13, Pirus, 18th Street gang, 8th Street gang, Clanton 14, Logan Heights Gang, Mongols, MC, Sureños, Norteños, Fresno Bulldogs, Tooner Ville Rifa 13, Varrio Nuevo Estrada, Venice 13 and White Fence? You only have a small window to turn in your magazines or face punishment. Gee, I hope they’re listening cuz I know they don’t wan’t to break a law.

    • Chris August 17, 2015, 4:12 pm

Right on, Slacking; you nailed it! Those Pillars of society must be the first ones getting in line too comply! 🙂

  • DRAINO August 13, 2015, 9:36 am

Yeah, kinda like the GA politician that thought Guam would flip over if more troops were stationed there is ALSO calling for “common sense” gun control laws……LOL!!!! I would have to say that real common sense is so rare in government these days that it really should be considered a super power. I have to agree about Kalifornia……get out now or plan on being a victim. I seriously hope they go after all these sanctuary city politicians and prosecute to the fullest. Including the illegal aliens. BTW….I say bring back “Operation Wetback”!!

  • George August 11, 2015, 10:52 am

More ignorance from politicians. As soon as you hear “common sense” from a politician, you just know that it won’t make any sense. So how will a reduced capacity magazine save a life? My take is that it could cost one. A homeowner, defending himself from multiple career California criminals would be forced to reload before all perps were down, and if he hasn’t practiced to do it, could be killed. Oh well, another reason for the sane to leave California. If you live there, you are not a resident, but a upcoming victim.

Those who support freedom should appreciate these laws. For multiple reasons, these laws increase the potential for the future to be a brighter place.

Those who continue to support this kind of tyranny by living within the boundaries of their control will be less likely to survive. As they die off, the impact the laws had will become a talking point amongst those who shy away from reality.

    Look on the bright side!

The Gov may not deprive citizens of their personal property or cause forfeiture of personal property without reimbursement except in criminal cases.
    Amendment IV Search and arrest
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

So much for the concept of “Grandfathering” anything regarding firearms. Just wait till they go after all the evil guns that they made their slave citizens register. Yeah, the mags could go underground but they have an address list for the law abiding folks that registered theirs. We all know that they will have probable cause to search the property.
60 Days to get rid of them. I bet there are a heck of a lot of shovels and post hole diggers being sold in LA County right now. We need to set up a Magazine Sanctuary and adoption service to find them good homes!

  • Dilligaf August 10, 2015, 6:58 pm

Cali (alongside New Jersey) is are/ the most COMMUNIST gun states They continue to infringe on the Second Amendment rights with the concept that tough gun control laws “saves lives” which has been proven time and time again to be utter bullshit.

Without reviewing the scope of how democrats acquire funds for their revolution against America, their decisions don’t make much sense.

Reviewing the workflow shows their true depravity. And no, I’m not pro republican.

      Start with a citizen.
Citizen is confronted with an armed criminal attacker. For the sake of the argument, let’s consider this person an illegal immigrant coaxed into giving Mexican narcoterrorists ten grand to cross the border. That ten grand is important because it was ninety siphoned out of whatever economy he was from and injected into the democrat party.
That citizen is injured by the alien.
Police are called. Paramedics are called. Criminal departs, so no need to call ice.
The moneys needed to support police and paramedics are laundered through union dues into the democrat party. Weapon purchases go to manufacturers who donate to democrats as bribes to increase crime. Lawlessness breeds gun buys.
The victim dies in the hospital.
Lawsuits filed against malpractice benefit lawyers who donate to democrats. Nurses unions, medical suppliers, pharmaceutical companies and the insurance companies all profit and launder profits through democrat donations to increase future revenue.
When the alien is finally apprehended, the jail to house him requires maintenance from union workers who donate only to democrats. The prison guards are unionized and launder their union dues through democrat bribes and donations.
The judges overseeing the probation given to the citizen of a foreign country here illegally donate to democrats.
Criminal is freed to conduct more crimes so that the parasitic siphoning of wealth can continue.

Think I’m biased? Go look up donation rates on opensecrets.org go look up the travesty of Jackson county Missouri prosecutors and judges giving extremely lenient sentences for heinous violent crimes. Nothing I’ve written here is conjecture.

      • Will Drider August 12, 2015, 11:34 pm

Your “Reviewing the workflow” should start with Once upon a time……
I reviewed your referenced info “source” site. References/facts to support your fairy tale as posted, are not there.
The details intertwined and extruded from irrelevant not mutually supporting sources of questionable reliability only confirm that tin foil hats wear out and should be replaced every few years.
This is just my opinion. It could be wrong but it is based on what you provided.

    • CTYANKEE August 17, 2015, 7:56 am

I hope someone out in Los Angeles files a lawsuit against illegal seizure. The City needs to pay for those destroyed magazines. The government can not make you turn in “property” that was legally paid for without compensation. Enjoy reading the case law on it…

    • bill August 17, 2015, 6:48 pm

dilli these dip s**t city CONcil people are the same brain dead liabilities that decided to remove a auto lane from both sides of 5 of the most heavily traveled avenues in the city and put in a BIKE LANE. 3 of these democrat CONcil members who voted for this silliness also asked their fellow CONcil members to exempt the areas that go through their districts. this city CONcil in los angeles is the most devious, criminal group ever and that includes al capones’ Chicago and new yawks tamany hall. please take note they are all democrats.

…Ummm is this important to me or the fact that my local councilman Juizar got balls deep in his secretary, the gave her a raise to the tune of some $150,000 + – then she sued the jack ass for sexual harassment and we paid for his defense and the settlement which was conveniently sealed. Maybe the fact that our parking tickets which run up to a days pay go to Xerox Corp. will get you going. Pre ban mags not soooo much.

    • bob August 17, 2015, 11:54 pm

These people are really that dumb hope some one breaks it to there home and is armed with just a knife that is to there neck,oh no 10 rounds here or even 30 rounds guess they figured out who the dumb ass is now.

    • Alan August 19, 2015, 9:27 am

In point of technical fact, this act is an example not of Communism, but Fascism. In a true altruistic Communist State, even the Police would NOT have guns.
In a Fascist State, ONLY the Police would have guns.
California Politicians are therefore Fascists, not Communists.
Lets not mince words here, the RINO’s have done that long enough.
Democrats have long been trodding the road to Fascism, it’s time to call them on that.
